Dear Sir:
On February 10, 2021, the Division of Water Resources (DWR) received a request from you, to appeal an
on -site determination made by Johnston County Utilities Department as provided in Title 15A NCAC
0213.0714 (4) of the Neuse River Riparian Buffer Rules. Specifically, the start point of Feature S2 was the
subject of the appeal.
On January 6, 2021, and May 20, 2021, Shelton Sullivan of DWR, conducted site visits to review Feature
S2. The January 6, 2021 visit was during the time of record rainfall; therefore, a later visit was planned.
During both site visits, DWR was accompanied by Wyatt Brown of Brown's Environmental, Charles
Pender of Johnston County, and representatives of J&N Developers, LLC. The US Army Corps of Engineers
also attended the January 6, 2021 site visit. DWR reviewed Feature S2 north of Falling Brook Drive,
adjacent to Lot 50, on the property to the north, and the area south of Falling Brook Drive. DWR used
available maps, site conditions, project history, file review, and the DWR Surface Water Identification
Method to evaluate Feature S2 for applicability to the Neuse River Riparian Buffer Rules 15A NCAC
0213.0714.
According to Title 15A NCAC O2B .0714 and based on the review, DWR has determined that "S2 North"
rates as an ephemeral channel north of Falling Brook Drive and not subject to the Neuse River Riparian
Buffer Rules. The ephemeral channel has been diverted to the roadside ditch on the north side of the road
from construction. DWR observed that "S2 South" is not a continuous channel and rates as ephemeral
South of Falling Brook Drive and near the confluence with Feature S2. DWR agrees that Feature S2 is
subject south of Falling Brook Drive as indicated on the plans included with the US Army Corps of

This determination is only for Feature S2 and replaces the determination originally performed by
the Johnston County as documented in their attached letter dated February 8, 2018. This
determination shall expire five years from the date of this letter.
This Determination can be contested as provided in Chapter 150B of the North Carolina General Statutes
by filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirements for filing a Petition are set forth in
Chapter 150B of the North Carolina General Statutes and Title 26 of the North Carolina Administrative
Code. Additional information regarding requirements for filing a Petition and Petition forms may be
accessed at httl2://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000.
One (1) copy of the Petition must also be served to the North Carolina Department of Environmental

This letter only addresses the applicability to the buffer rules on the subject property and does not
approve any activity within any riparian buffers. Nor does this letter approve any activity within waters
of the of the State or waters of the United States, which include wetlands. Please note that this buffered
feature may have additional requirements as per Johnston County's ordinance. Any activities along these
features may require 404/401 permits and certifications. Any inquiries regarding applicability to Section
404 of the Clean Water Act should be directed to the US Army Corps of Engineers Raleigh Regulatory Field

Riparian Buffer Ordinance (Section 14-393 Johnston County Code of Ordinances) has or have been
approximately shown on either the Soil Survey of Johnston County, North Carolina (1994) or the most
recent version of the 1:24,000 (7.5 minute) quadrangle topographic maps prepared by the United States
Geologic Survey (USGS), and have been located on the property and possess characteristics that qualify
it to be a stream. Each feature that is checked "Not Subject" has been determined not to be a stream or
is not present on the property. There may be other streams located on your property that do not show up
on the maps referenced above but still may be considered jurisdictional according to the US Army Corps
of Engineers and/or the North Carolina Division of Water Resources.

This on -site determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by Johnston County may request a
determination by the Director of the Division of Water Resources c/o the 401 and Buffer
Permitting Unit, or its successor. An appeal request must be made within sixty (60) days of the
date of this letter or from the date the affected party (including downstream and/or adjacent
owners) is notified of this letter. A request for a determination by the Director must be submitted
in writing with a copy of this letter to:

This determination is final and binding unless, as detailed above, a request for an appeal has been
made in writing within sixty (60) days.
The owner/future owners should notify the Division of Water Resources (including any Local,
State, and Federal Agencies) of this decision concerning any future correspondences regarding the
subject property (stated above). This project may require a Section 404/401 Permit for the
proposed activity. Any inquiries should be directed to the US Army Corps of Engineers Raleigh
Regulatory Field Office at (919) 554-4884 and the Division of Water Resources 401 & Buffer
