Subject: Request for Approval to Utilize Small Impacts Guidance

Dear Mr. Tugwell,
The purpose of this letter is to request approval from the Interagency Review Team (IRT) to utilize the Small
Impacts guidance as outlined in the Section IV. E of the North Carolina Department of Environment and Natural
Resources' Ecosystem Enhancement Program In -Lieu Fee Instrument signed August 27, 2010. Section IV. E of the
instrument states:
Small Impacts
If, within any 8 -digit cataloging unit, the cumulative mitigation requirements In any given North Carolina State
Governmental Fiscal Year are less than I, 000 linear feet ofstream or 3 acres of wetlands, the NCEEP may
make a request to the DE and IRT to satisfy the mitigation requirements by use of credits from an adjacent
cataloging unit within the same river basin, use of High Quality Preservation, implementation of BMPs
identified in a Local Watershed Plan, or other mitigation options as approved by the DE and IRT. Penalties to
include additional mitigation, may apply if it is determined to be appropriate by the DE in consultation with the
IRT. The IRT, with concurrence of the DE, will provide a response within 60 days of the proposal. In the event
that the proposal is not acceptable, the NCEEP will be obliged to satisfy the mitigation requirements pursuant
to the conditions of the permit.
EEP identified 5 permit requirements in the Statewide Stream and Wetland ILF and 4 permit requirements in the
NCDOT Stream and Wetland ILF where EEP is requesting that the IRT consider for approval to utilize the small
impact guidance. The requirements are located in 5 river basins and 7 cataloging units, and total 151 stream and
3.44 wetland credits. The list of mitigation requirements and the proposed mitigation sites for application under the
small impact guidance is attached.
Additionally, EEP requests approval to utilize Barra Farms I mitigation bank credits to satisfy 9 nonriparian wetland
mitigation requirements totaling 3.99 credits. The impacts are located within the same 8 -digit Cataloging Unit as the
bank but not within the bank's primary service area.
Lastly, in accordance with the 2007 and 2008 Interagency Surplus workshop and in accordance with Section IV (A)
of the 2010 EEP ILF Instrument, EEP is requesting approval to utilize existing legacy surplus mitigation for
projected NCDOT mitigation needs in Chowan 03010204 and Cape Fear 03030007 as well as an extended service
area for Chowan 03010204. The specifics ofthe request are included in Attachments HA and 11B.

Attachment 11A. Request to Utilize Legacy Surplus Mitigation Credits to Meet Pro ected NCDOT Needs
Chowan 03020104
EEP is requesting advance approval to utilize existing available riparian and non- riparian wetland mitigation
assets located in Pasquotank 03010205 for riparian and non- riparian wetland mitigation needs in Chowan
03010204. Pasquotank 03010205 has very large riparian and non - riparian wetland mitigation surplus mostly
associated with legacy NCDOT mitigation projects. The NCDOT is projecting large riparian and non - riparian
wetland impacts primarily associated with TIPs R -2584A (US 158 widening and some new location in
Northampton County) and R-5311 (US 13 /NC 11 Improvements in Hertford County). Total projected riparian
wetland impacts are 99.87 acres and total non - riparian wetland impacts are 91.6 acres in Chowan 03010204
(See attachment A for complete list of projected NCDOT impacts).
History:
Over the last several years, EEP staff have conducted numerous searches in Chowan 03010204 for suitable
wetland mitigation sites and issued four Full Delivery Request for Proposals (FD RFPs) requesting mitigation
sites. EEP has awarded two contracts for mitigation sites with FD RFP providers neither containing non -
riparian wetland mitigation credits. The sites are Cutawhiskie Creek located in Hertford County and produced
3,417 stream and 12.45 riparian wetland credits and Stanleys Slough located in Northampton County and is
projected to yield 4,248 stream and 2.80 riparian wetland credits.
Available Non- Riparian Credits:
Mitigation projects developed at NCDOT or EEP that have available non - riparian mitigation assets in
Pasquotank 03010205 consist of:
• Dismal Swamp, Gates County ( NCDOT), 262.69 non - riparian credits
• Dismal Swamp Full Delivery, Tyrrell County (EEP), 273.50 non - riparian credits
• Great Dismal Swamp (GDWRB), Tyrrell County ( NCDOT), 106 non - riparian credits
• Scuppernong River Mitigation Bank, Tyrrell County ( NCDOT), 15.15 non- riparian credits
These four sites combined currently have over 650 non - riparian wetland mitigation credits. There are
approximately 18 non - riparian wetland mitigation credits projected to be needed in Pasquotank 03010205
over the next five years. NCDOT has also reviewed anticipated TIP projects within the next ten years and still
project a non - riparian wetland mitigation surplus for Pasquotank 03010205. EEP has coordinated this request
with the NCDOT and they are supportive of this proposal.
Available Riparian Credits:
Mitigation projects developed at NCDOT or EEP that have available riparian mitigation assets in Pasquotank
03010205 consist of:
• Balance Farm, Currituck County ( NCDOT), 202.8 riparian credits
• Dismal Swamp, Gates County ( NCDOT), 21.04 riparian credits
• Dismal Swamp Full Delivery, Tyrrell County (EEP), 179.5 riparian credits
• Perry Property (UT to Pembroke), Chowan County ( NCDOT), 7.99 riparian credits

There are 45.37 projected surplus riparian wetland credits located in Pasquotank 03010205 after accounting
for future NCDOT needs in this CU. These are, however, insufficient to meet all the needs for Pasquotank
03010205 and Chowan 03010204. EEP intends to issue a FD RFP for riparian wetland mitigation credits to
offset the anticipated riparian wetland mitigation needs. EEP requests that the service area be expanded to
improve the likelihood of receiving and awarding sufficient riparian wetland mitigation credits to meet the
anticipated need in Chowan 03010204. The proposed area would consist of Chowan 03010203, 03010204 and
Pasquotank 03010205. EEP issued three FD RPFs for Chowan 03010203 over the years which yielded three
projects (Duke Swamp and Powell Property in 2006 and Hofler Property in 2012). NCDOT is also supportive of
this proposal to meet the mitigation needs.

EEP is requesting advance approval to utilize existing available surplus non- riparian wetland mitigation assets
located in Cape Fear 05 for projected non- riparian wetland mitigation needs in Cape Fear 03030007. Cape
Fear 03030005 has very large non - riparian wetland mitigation surplus mostly associated with legacy NCDOT
mitigation projects. The NCDOT is projecting large non- riparian wetland impacts associated with TIPs U -4751
and R -3300 (Military Cutoff Extension and Hampstead Bypass, New Hanover County). The projected non -
riparian wetland impacts associated with the projects is 100.0 acres. EEP has sufficient non - riparian
Restoration Equivalent (RE) mitigation credits available in Cape Fear 03030007 and plans to the meet the RE
needs of these projects in the CU.
History and Available Credits:
Over the last several years, EEP has issued four Full Delivery Request for Proposals (FD RFPs) requesting
stream, riparian wetland and non - riparian wetland mitigation credits in Cape Fear 03030007. EEP has awarded
five contracts for mitigation sites with FD RFP providers with only one site containing a small amount of non -
riparian wetland mitigation credits. The sites are Best Site, Muddy Run, Muddy Run ll, and Twin Bays located
in Duplin County and Haw Branch located in Onslow County. Only the Twin Bays site is anticipated to produce
a small amount of non- riparian wetland mitigation credits which are mostly needed forthe Statewide ILF
program. There are several projects in Cape Fear 03030007 with riparian wetland mitigation credits that are
not projected to be fully utilized in the CU. These projects are Haw Branch ( Onslow County), Grove Creek
(Duplin County), and Haw's Run (Pender County).
The following mitigation projects developed at NCDOT and are considered legacy surplus projects. These sites
have available non - riparian mitigation assets in Cape Fear 03030005:
Dowd Dairy, Bladen County ( NCDOT), 450.75 non - riparian credits
® Barra Farms Mitigation Bank, Cumberland County ( NCDOT), 158.93 non - riparian credits (expanded
service area consist of portions of Cape Fear 04, 05 and 06

After meeting the non- riparian wetland mitigation needs in both Cape Fear 03030005 and 03030006, there will
still be more than sufficient surplus non - riparian wetland mitigation credits to meet the non- riparian wetland
mitigation needs in Cape Fear 03030007. EEP is requesting approval t0 utilize existing closed out non- riparian
wetland restoration mitigation credits located in Cape Fear 03030005 for the non - riparian restoration needs in
Cape Fear 03030007.
