Dear Mr. Carlisle:
On January 31, 2007, the Division of Water Quality (DWQ) received your After-The-Fact application
dated January 23, 2007 to impact 0.092 acres of 404/wetland to construct the proposed road 3 crossings
and bridge to provide access to the southwest portion of the subject property. On March 5,2007, the
DWQ sent correspondence requesting additional information from you. On May 21, 2007, the DWQ
received correspondence via email from your agent, S&EC, P.A., indicating that a revised submittal and
proposed stormwater plan would be submitted to the DWQ by July 20, 2007. On July 13, 2007, the
DWQ received correspondence via email from your agent indicating that the revised submittal and
proposed stormwater plan would be submitted to the DWQ "near the end of August to the middle of
September timeframe ".
For these reasons your permit application is hereby considered returned. Once you have redesigned your
project to address the problems and inadequacies with your application as it was submitted, you will need
to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate fee. In the interim, the DWQ strongly encourages you to contact the DWQ to schedule a
meeting to discuss your project.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity
and any work done within waters of the state would be a violation of North Carolina General Statutes and
