Quality Received NOV 2 9 2021 W°inston_Scicm Regional Office On October 26, 2017, the Department of the Army issued a permit to Development Solutions BRY, LLC for the grading and placement of fill material in 1,350 linear feet of stream and 0.1897 acre of wetlands to facilitate the construction of Bryton-mixed use residential development located in the northeast quadrant of the intersection of Hambright Road and NC-116(Old Statesville Road) in the Town of Huntersville, Mecklenburg County, North Carolina. A written request for a permit modification was received on September 8, 2021, for an extension of the work deadline and the addition of two new permittees based on certain project components being conveyed to these parties. have determined that the proposed project modifications described above are not contrary to thepublic interest and are consistent with the 404(b)(1) Guidelines and therefore, the DA permit is hereby modified. The additional authorized work shall be completed in accordance with the attached drawings. All other conditions of the original permit remain applicable. The permit is modified as described below. 1) Extension of the date for completion of work from August 10, 2022 to August 10, 2024. 2) Incorporate Ardmore Capital Group, LLC, D.R. Horton, Inc., and Development SolutionsBRY, LLC as joint permittees under SAW-2015-01762. A description of each permittee'sproject component as it relates to specific authorized impacts is listed below. (a) Ardmore CapitalGroup, LLC: (i) Impact Number 6 for a proposed road crossing consisting of 122 linear feet (permanent stream impact), 40 linear feet (temporary stream impact), 0.004 acre (permanent wetland impact), and 0.0077 acre (temporarywetland impact). -2- (b) D.R. Horton, Inc.: (i) Impact Number 2 for a proposed road crossing consisting of 133 linear feet (permanent stream impact), 67 linear feet (temporary stream impact), and 0.048acre (permanent wetland impact); (ii) Impact Number 4 for a proposed road crossing consisting of 41 linear feet (permanent stream impact) and 41 linear feet (temporary stream impact); and, (iii) Impact Number 5 for a proposed road crossing and lot fill of 206 linear feet (permanent stream impact) and 0.0349 acre (permanent wetland impact). (c) Development Solutions BRY, LLC: (i) Impact Number 1 for a proposed road crossing and lot fill consisting of 179linear feet (permanent stream impact) and 0.095 acre (permanent wetland impact); ii) Impact Number 3 for a proposed sewer crossing consisting of 15 linear feet (temporary stream impact); iii) Impact Number 7 for proposed lot fill consisting of 122 linear feet (permanent stream impact); and iv) Impact Number 8 for proposed lot fill consisting of 401 linear feet (permanent stream impact). This approved modification should be attached to the original permit and will be utilized for futurecompliance reviews of the project.
