This letter is to acknowledge receipt -of the faxed copy of the TRE Progress report on October 15, 2002.
The report summarizes findings and activities for the period of July through September 2002. On October
16, 2002, this office. received the three bound copies as called for in the Special Order by Consent. Two
copies of the Progress Report were forwarded to the Aquatic Toxicology Unit and the Pretreatment Unit in
Raleigh for review., The documentwas prepared by the Town of Fairmont's toxicity consultant,
SIMALABS International (forruerly Burlington Research), and submitted to satisfy item 2(c) of the
Town's Special Order by Consent.
The TRE Progress Report states that toxicity results for the report period indicates that acute toxicity and
chronic toxicity were absent in all test procedures as well as compliance with all NPDES permit
parameters. As previously noted in meetings and correspondence, this office remains concerned with the
whole effluent toxicity potential from IN7. File information indicates that flow at IN7 may increase to
150,000 GPD. This concern is heightened due to the apparent lack of response from IN7 to SIMALAB'S
June chemical usage review questions.
Due to the potential effects of the IN7 industrial contributions on the Town's wastewater treatment
facility, we ask the Town to work "very" closely with the DWQ Pretreatment Unit. By working closely
with the Pretreatment Unit the Town may avoid future NPDES violations caused by industrial sources
while meeting the needs of the Town's economic development.

As noted, the SOC under which the Town operated its old treatment facility expires December 15, 2002.
This letter is also to serve as follow-up to a conversation with Mr. Ben Hill, Town Manager, today
(October 23, 2002) concerning the still active Special Order By Consent (SOC). Based on that
conversation, it is our understanding that the Town will soon request that the SOC be rescinded.
