Bryan,
Please note that if you make any changes to the Compensatory Mitigation Plan for the project
(dated November 2012 and received by the Division on December 18, 2012), a modification to
the Individual Certification would be required.
Thanks,

All-
I've attached the 401 approval letter that was issued in December 2012, which included onsite
and offsite preservation. Cyndi Karoly is the most familiar with this project; she is out of
the office this week but will be back on Monday. Bryan, if you're sending in another
modification request, please talk with Cyndi.
Thanks -
Karen

we MAY be able to accept 32 acres of offsite preservation and preservation of the remaining
onsite wetlands as the mitigation for this project. We now have someone new with EPA and
with DWR (formerly DWQ). State law requires a minimum 1:1 ratio of restoration, such as
payment to a bank. DWR may require this now, even though it seemed that they were going to
be able to accept only preservation last year. I can't make that call for them. I would
recommend you contact DWR before you send in the modification request.

> Thomas, thanks for talking with me last Friday. I will be sending you a re -newed
modification request for the permit referenced above in 7ohnston Co. Could you please send
me the last iteration of the permit (I assume as was approved after the public comment period
ran at the end of last year)? I wanted to make sure I asked for what was granted, as the
last letter I have is Oct. 29, 2012 to you that lists a number of options. It appears we
don't need the options anymore, I just wanted to make it as clear and concise as possible.
