There are five (5) streams and nine (9) wetlands on site. CH 100 has perennial and intermittent reaches. There is 5,209 linear feet of stream (CH 100 - perennial and intermittent, CH 200 - intermittent, CH 300 - perennial, CH 400 - intermittent, and CH 500 - perennial) on site. There is 0.076 acre of wetlands (WL 1000, WL 1100, WL 1200, WL 1300, WL 1400, WL 1500, WL 1600, WL 1700, and WL 4000)within the project boundary. The Corps approved the Jurisdictional Determination request on September 24, 2021. The enclosed permit application request is for 256 linear feet of stream (226 linear feet of permanent impact and 30 linear feet of temporary impact) impacts and 0.055 acre of permanent wetland impacts in order to facilitate construction of an industrial distribution /warehouse logistics center(two buildings), truck courts, employee parking, road access around the building, a sewer line extension, and four storm water SCM's. Permanent impacts to perennial stream CH 100 of 126 linear feet (0.015 acre and 12.1 cubic yards) and intermittent stream CH 100 of 100 linear feet (0.005 acre and 4.4 cubic yards) are requested to facilitate driveway access into the property. CH 100 runs parallel to NC-152 for the entire project boundary so crossing this stream is unavoidable. Temporary impacts to perennial stream CH 500 of 30 linear feet (0.002 acre and 1.6 cubic yards) is requested for construction of a sanitary sewer line. The stream bed and banks will be restored to pre-existing conditions once construction is complete. Wetland impacts to WL 1000, WL 1100, WL 1400, WL 1700, and WL 4000 are requested totaling 0.055 acre. Impacts at WL 1000, WL 1100, and WL 4000 are for grading and fill of the building pads and parking areas. Impacts at WL 1400 and WL 1700 are for the two driveway access points into the property. All streams on site are unnamed tributaries to Cold Water Creek which is classified as a "WS- IV"water by the North Carolina Division of Water Resources. This area is very attractive for industrial development due to the existing development already present in the vicinity as well as its close proximity to highways and interstates. The planned industrial distribution /warehouse buildings logistics park is being constructed with features and flexibility to attract a wide array of tenants that are interested in occupying this product type in this location. The developer already has very strong interest in the larger building. The buildings will have specific design features to meet the demand expectations of tenants interested in this location and ultimately attract high quality tenants that will lease the space over the long term. A variety of businesses across multiple industries will be able to utilize this development in this location depending on their warehouse space needs. Business activities among these tenants may include freight forwarding, third party logistics, food/beverage distribution, light assembly/ manufacturing, wholesalers, and others. Businesses that benefit from logistical efficiencies associated with proximity to population centers, intermodal hubs, and interstate highways will be especially interested in this development due to its location to the Charlotte/Concord/Salisbury urban core, Interstates 85, 77, and 485, Charlotte Intermodal, and Charlotte Douglas International Airport. The proposed industrial use of the property is consistent with the City of China Grove's adopted land use plan. Users of such buildings often require anywhere from 100,000 square feet to 2.5 million square feet. While the property's location has certain logistical advantages for industrial warehouse users, these tenants will require competitive market rents to operate out of these proposed facilities. Rental rates are directly related to the cost of the land and improvements, much of which is fixed regardless of the size of the building being developed. These fixed costs, which this development also will incur, include the land itself, utility infrastructure improvements, offsite roadway improvements, legal and financing costs, marketing, construction costs, and other costs. As these fixed costs are spread over a smaller building, the required rental rates increase to the point that they are above-market, thus making the investment financially unfeasible. Furthermore, as building sizes decrease, economies of scale for the physical improvements are lost. Factoring in the economies of scale, the entire development costs increase by 30%-35%, driving market rents higher than tenants are willing to pay and making the development financially unviable. In the current market tenants need larger buildings in order to account for the increase in on-line shopping and quick delivery deadlines. Stream or wetland mitigation should not be required for project impacts. Stream impacts do not exceed 0.02 acre and wetland impacts do not exceed 0.10 acre. Enclosed is a copy of the US Fish and Wildlife Service (FWS) Section 7 comment letter. Section 7 consultation with the Service has been satisfied. Enclosed is a copy of the NC Historic Preservation Office (HPO) Section 106 comment letter. The HPO office had no comment related to project impacts. Section 106 consultation with the Service has been satisfied. Based on the original comment letter received from FWS to ensure that no Helianthus schweinitzii occurs on site, Atlas staff revisited the project location on August 31, 2021 to conduct a supplemental site survey. During this most recent field survey for Helianthus schweinitzii completed on all potentially suitable habitats no sunflowers were observed. This supplemental survey was completed during the flowering period. No Helianthus schweinitzii is present at the China Grove Industrial project. A temporary culvert will be used to gain access across the stream during construction of the sewer line extension. The sewer line will be trenched at this location prior to installation of the temporary culvert. The stream bed material will be side cast and stock-piled to use during stream restoration. After construction is complete the culvert will be removed. The pre-existing stream bed elevation will be re-established with the stock-piled bed material. Once the stream banks are graded to the pre-existing slope, a native seed mix will be used on the banks. Coir matting will be installed with wooden stakes to ensure long term bank stability. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended(16 U.S.C. 661-667e); the National Environmental Policy Act(42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended(16 U.S.C. 1531-1543) (Act). Project Description According to the information provided,the Applicant proposes to construct an undisclosed commercial development on approximately 200 forested acres in China Grove,North Carolina. The information provided suggests that the proposed project will require authorization from the U.S. Army Corps of Engineers for impacts to Waters of the United States. Based on the information provided and aerial imagery, onsite habitats are dominated by successional mixed forest,but also contain forested riparian and wetland habitats (unnamed tributaries to Coldwater Creek),maintained utility and road rights of way,maintained open space, agricultural lands, and transitional edge habitats. No project design plans or a description of impacts to onsite habitats have been provided at this time although your correspondence indicates that a preliminary site plan has been developed. Federally Listed Endangered and Threatened Species According to Service records, suitable summer roosting habitat may be present in the action area (50CFR 402.02) for the federally threatened northern long-eared bat(Myotis septentrionalis). However,the final 4(d)rule, (effective as of February 16, 2016) exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season(June 1 —July 31). Based on the information provided,the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d)rule for this species. Although not required,we encourage the Applicant to avoid any associated tree clearing activities during this animal's maternity roosting season from May 15—August 15. Historic and current records of the federally endangered Schweintiz's sunflower(Helianthus schweinitzii)occur in the vicinity of the project. A variety of habitats create suitable conditions for this plant species and include maintained roadsides,maintained utility rights of way, forest openings,forest edges,edges of agricultural fields, and other transitional edge habitat types. Your June 11,2021 and September 14,2021 correspondences indicate you believe these suitable habitats do not occur onsite. If the action area contains suitable habitat for this species,but negative survey results were collected during the appropriate timeframe,1 we would concur with a"may affect,not likely to adversely affect"determination from the action agency. Our concurrence with a"no effect" determination from the action agency is not required. In accordance with the Act, it is the responsibility of the appropriate federal agency or its designated representative to review its activities or programs and to identify any such activities or programs that may affect endangered or threatened species or their habitats.
