RAWLS Director TO: Gregg Bodnar, NCDCM Assistant Major Permits Coordinator FROM: James Harrison, NCDMF Fisheries Resource Specialist SUBJECT: Darious Ballou, Carteret County DATE: 16 November 2021 A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the permit application for proposed actions that may impact fish and/or fish habitats. The applicant is proposing to replace and reconfigure the existing 6-slip docking facility with a new 6-slip structure (4 slips within the canal and 2 slips on the jet dock). The reconfiguration involves 2 finger piers, a boat lift, a fixed platform, a floating jet dock with gangway, and a floating platform with a gangway. Shellfish resources were observed during the permit site visit as well as during additional site visits related to a CAMA violation at the site. DMF recommends that any issued permit include measures to avoid or minimize impacts to shellfish resources. Any shellfish that are present within the footprint of proposed pilings or under the proposed floating structures should be relocated to an area outside of the project footprint. DMF also recommends that the platform include design elements that would prevent the structure from being used for docking, such as railings. Finally, the permit should be conditioned on no additional slips being proposed in the future. Thank you for consideration of our comments and concerns.
