The review indicated the following deficiencies.  Failure to submit a new monitoring well plan and associated documentation within 90 days of permit issuance. Part I.3 requires within 90 days of the effective date of this permit, the Permittee shall submit a new monitoring well plan for monitoring wells MW-1C, MW-2C, and MW-3C to be located near Basin C to the Asheville Regional Office, telephone number (828) 296-4500, mailing address Division of Water Resources, 2090 U.S. 70 Highway, Swannanoa, NC 28778-8211. This submittal shall include a site map, an engineer’s statement for the basis of design for the proposed monitoring well locations, and the proposed well construction parameters for the installation of three new monitoring wells to replace MW-2, MW-3, and MW-4. The Asheville Regional Office shall approve monitoring wells MW-1C, MW-2C, and MW-3C prior to installation, and the monitoring wells shall be installed within 180 days of the effective date of this permit. The Asheville Regional Office shall be notified at least two business days in advance of construction of any monitoring well. The monitoring wells shall be constructed such that the water level in the well is never above or below the screened portion of the well, and in accordance with 15A NCAC 02C .0108. [15A NCAC 02C .0108, 02T .0108(b)(1)(B)]  Failure to submit a final operation and maintenance plan within 30 days of permit issuance . Part I.7 requires within 30 days of the effective date of this permit, a Final Operation and Maintenance Plan meeting the requirements of 15A NCAC 02T .0707(a) shall be submitted for review. The plan shall be sent to the Division of Water Resources, Non-Discharge Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 or Non-Discharge.Reports@ncdenr.gov. Within 60 days upon receipt of this Notice, complete and submit the new monitoring well plan to the ARO. This shall include a site map, an engineer’s statement for the basis of the well placement, and the proposed well construction parameters. The ARO will consider extending the original deadline for the construction of the monitoring wells by an additional 30 calendar days (March 11, 2022) if the monitoring plan is submitted within 60 days. As a reminder, the Asheville Regional Office shall approve the monitoring wells before installation. 2. Within 30 days upon receipt of this Notice, submit a complete Final Operation and Maintenance Plan to the Non-Discharge Branch in Raleigh. This can be submitted to non-discharge.reports@ncdenr.gov or through the online portal at New Submission (nc.gov). Please carefully review all compliance dates listed within the permit. The original monitoring wells are required to be properly closed out within 180 days of permit issuance.
