Skvarla, III Secretary DWQ # 13 -1213 Martin County On -Site Determination for Applicability to the Tar - Pamlico River Riparian Area Protection Rules (15A NCAC 2B.0259) Dear Mr. Roberson: On December 2, 2013, at your request Anthony Scarbraugh conducted on -site determinations to review an unnamed tributary (UT) to Flat Swamp and Flat Swamp located on the subject property for applicability to the Tar - Pamlico Buffer Rules (15A NCAC 2B .0259). The features are labeled as "13 -1213 A and 13 -1213 B" on the attached maps initialed by Mr. Scarbraugh on December 4, 2013. The project is located approximately 0.5 miles southwest of the intersection of NC Highway 903 and NCSR 1159 (Flat Swamp Road) near the town of Robersonville, Martin County. At your request, Mr. Scarbraugh conducted on -site determinations as stated above. During his review, he evaluated the stream using the DWR Stream Classification Form. He evaluated the stream reach at 13 -1213 A at N 35.81590, W 77.26417 and calculated the score to be 40.75 points. He evaluated the stream reach at 13 -1213 B at N 35.81835, W 77.25874 and calculated the score to be 31 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent." The Division of Water Resources (DWR) has determined that the portion of the features labeled as "13 -1213 A and 13 -1213 B" on the attached maps, and highlighted in blue is subject to the Tar - Pamlico Buffer Rules.
