PROJECT DESCRIPTION: The project site is located at 65 Capps Road, adjacent to the AIWW, in Wilmington, Pender County. To locate the property from the WIRO office, drive north on NC Highway 17 and turn right onto Scotts Hill Loop Road. Follow Scotts Hill Loop Road approximately 2.32 miles and the property will be located on the right hand side of road, just south of 2344 Scotts Hill Loop Road. The property consists of a 1/2-acre parcel that is situated on land that is approximately 21-23 feet above mean high water (MHVi>) and is vegetated primarily with lawn grasses. A single-family residence occupies the highground portion of the property. The shoreline is natural (no man- made shoreline protection features), and coastal and 404-type wetlands extend waterward from the high ground, a distance approximately 90 linear feet. Groundsel bush (Baccharis halimifolia) and Bulrush (Scirpus spp.) are among the species that vegetate the area immediately waterward of the transition zone. Waterward of this zone, Smooth Cordgrass (Spartina altern flora), intermixed with Glasswort (Salicornia spp.) and Sea Lavender (Limonium carolinianum), span along the tidal flat a distance of approximately 55' before reaching the open water area of the A1WW. The width of the waterbody measures approximately 550' from marsh to marsh in this location. Submerged aquatic vegetation (SAV) is present along the shoreline of Scotts Hill Loop Road, but a July 1, 2021 site visit (during an negative low tide) did not reveal evidence of any SAV in the proposed project area. Currently, a pier and platform exist at the property and both were authorized under CAMA General Permit GP466109, which was issued on 10/7/2015. The permit authorized construction of an access pier (6' x 127') and a fixed platform (6' x 10'). Water depths in the vicinity of the existing platform range between 4 and -1.2', relative to Mean Low Water (MLW). The waters of the AIWW are classified SA-ORW by the Division of Water Quality. The project area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new S' x 65' floating dock and two 14' x 14' boatlift waterward of an existing pier and platform, creating four (4) boat slips. As proposed, the applicant is requesting authorization to construct a four -slip docking facility by installing a new S' x 65' section of floating dock, which would originate just out board of the existing 14' x 22' fixed platform. As designed, the floating dock would extend toward the east and run in alignment with the existing pier (perpendicular to shoreline). On either side of the floating dock, and at the terminal end, the applicant proposes to install two, 14' x 14' boatlifts. Existing water depths along the outboard side of the existing platform are approximately -1.2', relative to normal low water and drop off to approximately -2.5' at the terminal end of the proposed floating dock. Water depths along the run of the proposed floating dock range from -1.6' to -2.5', NLW. 10. ANTICIPATED IMPACTS The proposed docking facility would result in the incorporation of approximately 912 square feet of Estuarine Waters and Pubic Trust .Area. No impacts to Coastal Wetlands or any SAV should be impacted as a result of the project. The proposed development would be located within of the adjacent 15' riparian corridor setbacks on both sides and would be constructed outside of the federal channel setback, within'/4 of the width of the waterbody and within the established pier -head line. Turbidity associated with the piling installation should be kept to a minimum. Still need to get the revised drawing showing the water depths and width of waterbody (1/4 width limitation). I stopped by there today and there is not much water out front of the platform (20' from end). I know we have a lower than normal low tide, but 1 believe he's going to have less than 2' at the near shore edge of the floating dock. I'd check water depths one more time at a normal low tide and show an accurate reading on the site plan drawings. The water depths will be verified by other agencies and if there is less than 2' along the near shore edge at low tide, you're going to have to "pre -file" with the NC Division of Water resources. In reviewing your application, the Division has discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit the following additional information to this office: On 7/1/2021 DCM visited the property to verify water depths along the shoreline, in the vicinity of the proposed floating dock. The site visit was conducted around 8:20--8:30 am, with a normal low tide at Masonboro inlet at 07:50 am. Based on DCM's site visit, water depths were collected and reported as follows: @ approximately 15' from the waterward end of the existing platform, water depths averaged 1.4' @ approximately 45' from the waterward end of the existing platform, water depths averaged 1.8' @ approximately 65' from the waterward end of the existing platform, water depths averaged 2.0' - Although this area is not designated as a primary nursery area, you are still required to pre -file with the NC Division of Water Resources 401 Water Quality Section, if water depths in the vicinity of the proposed docking facility are less than 2.0' at normal low water. I have included a link below to those pre -filing requirements. In order for DCM to consider your application package complete, 30 days must have passed from the date of initial pre -file. Also, you will need to provide a copy of your pre -filing req nest form along with your CAMA Major permit application. Based on the information you provided on your revised site plan (which will need a revised date put on the drawing somewhere once you finalize it), you collected water depths on September 23, 2021 @ 4:45 pm. Based on NOAA's tide chart for Masonboro Inlet on September 23, 2021, low tide was at 4:34 pm and was 0.51' higher than normal which would change your depth information by -0.5', or six inches. The change in depth from what you have shown on the site plan, to that which was reported by NOAA and also documented by DCM staff on July 1, 2021 is off by approximately 6 inches. Please revise the site plan to accurately reflect the water depth measurements at the site and put a revised date on ail of the drawings.
