Fields 390 Sierra Circle Stanford, Kentucky 40484 Subject: Dear Mr. Fields: NOTICE OF VIOLATION NOV-2014-1 418 Circle Drive, Gibsonville, NC Illicit Discharge Town of Gibsonville Within the last couple of days Rob Elliott, Gibsonville's Public Works Director, investigated an illicit discharge on your property. As previously noted the private sewer pump house that serves the rental residence at 418 Circle Drive, Gibsonville, NC showed evidence of a sewer spill and a large puddle of sewer was on the ground directly beside the pump house. The sewage discharge is similar in type and location to previous discharges, including the one December 2013 that was referenced in NOV 2013-2. A raw sewage discharge represents both an illicit discharge under Town Ordinance and a public health issue. The Town's Illicit Discharge Ordinance outlaws water pollution including raw sewage. ine Due to the nature and ongoing issues with the discharge, the Town requires that the issue be resolved as quickly as possible. This should include a pumping and hauling operation to clean the sewer off the ground and keep the area around the pump house clean immediately. Because the pump is part of the sewer service, rather than the sewer main, it is the owner's responsibility to fix the issue. The discharge and the cause of the discharge need to be resolved within 7 days of this letter, by noon on July 3, 2014. Failure to respond to this request or failure to clean up the discharge and fix whatever issues may be causing the discharges will necessitate the Town seeking enforcement actions. These actions could include the following: • Payment of a fine up to $37,500 per day after July 3, 2014. • Deeming the violation a Public Nuisance and requiring cleanup with an assessment to cover all cost associated with the cleanup and a potential fine. • Disconnection of water and sewer service. 740 Chapel Hill Road (27215) - P.O. Upon completing the cleanup process, you will need to provide documentation that the source of the spill has been repaired and establishing that the nearest stream does not have elevated fecal coliform levels.
