This letter is hereby issued to Engineered Plastics Inc. by the Town of Gibsonville for the illicit
discharge of a tar like substance from the roof of 212 Chase Street into the Town of
Gibsonville's Municipal Separate Storm Sewer System (MS4).
On August 81", 2016 the Town went to 212 Chase Street to investigate a complaint of a ditch,
running from Joyner Street along the back of homes on Wood Street, having a black substance.
Town staff traced the substance to the back of the engineered plastics mill at 212 Chase Street.
We have attached pictures to this letter to indicate the tar like substance from the roof of
Engineered Plastics is escaping into the MS4.
The observed discharge is a violation of the Town of Gibsonville's Phase II Stormwater
Ordinance. The Town of Gibsonville's Phase II Stormwater Ordinance states that no person shall
cause or allow the discharge, emission, disposal, pouring, or pumping directly or indirectly to
any stormwater conveyance, the waters of the State, or upon the land in a manner and amount
that the substance is likely to reach a stormwater conveyance or the waters of the State.
You must cease future discharges of this nature. Please have all repairs completed and notify
the Town for a follow up inspection within twenty-one (21) days of the date of this letter.
Failure to comply may be subject to a Civil Penalty. Civil penalties will be assessed as
established in Section 8-5.1 of the Town's Land Development Ordinance or up to the full
amount of any penalty to which the Town of Gibsonville is subject for violations of its Phase II
Stormwater permit.
