ENGINEERS AND ARCHITECTS 740 chapel hill road/ P.O. box 1248 burlington, north carolina 27215-6453 (336)226-5534 - fax (336) 226-3034 Town of Gibsonville 2020-2021 Stormwater Engineering Services Protect Number — 20076 SW Memorandum of Agreement This _,&— day of -N T 2020, ALLEY, WILLIAMS, CARMEN, & KING, INC., hereinafter called Engineer, and the ✓To of Gibsonville , herein after called the Owner; agree that the Engineer shall perform professional services as set forth below related to providing engineering services related to the Town's Stormwater System. A. Background: This agreement is for Engineering Services associated with stormwater system for the Town of Gibsonville. This contract is to assist the Town with operating it's stormwater system for the benefit of the community. This contract is a continuation of the work generally associated with AWCK's job number 10080 and 09184 for stormwater services. B. Engineer's scope of work under this Memorandum of Agreement: Services during Stormwater System Engineering Phase: 1. Provide Town with a designated professional to serve as the Town's Stormwater Administrator. Designated Stormwater Administrator is to have at least 10 years of stormwater experience, is to be well qualified with stormwater, is preferred to be a professional engineer and is to be familiar with municipal stormwater permitting as well as nutrient requirements associated with surface water runoff. This person is also to be qualified through NC DEQ for surface water identification. 2. Assist with providing updates of Town Municipal Separate Stormwater System (MS4) and GIS maps and information. 3. Provide oversight of the Town's implementation of all six (6) minimum control measures for compliance with the Town's NPDES Phase 2 MS4 Permit. 4. Provide oversight of the Town's implementation of its Jordan Lake Stage 1 Existing Development Program and it's Jordan Lake Riparian Buffer Program. 5. Prepare annual reports for both the NPDES Phase 2 MS4 Permit and the Jordan Lake Stage 1 Existing Development Program. 6. Represent the Town on the NC DEQ's Jordan Lake Scientific Advisory Board. 7. Provide technical review and assistance for FEMA and non-FEMA floodplain development permitting. Provide evaluation of flood studies. 8. Review and address drainage complaints from town residents. 9. Maintain town standards and details related to the stormwater system. 10. Meet with residents, developers, and others regarding stormwater system. 11. Attend board meetings and other town meetings as requested. 12. Provide technical advice on a wide range of stormwater issues including engineering reports and technical letters. 13. Evaluating, scoping, and assisting with funding opportunities for special or capital projects. 14. Assist with drafting agreements with NCDOT and Developers. 15. Assist town with miscellaneous stormwater engineering tasks as directed by staff. 16. Coordinate between Town staff and other consultants (PTRC's Stormwater Smart). 1IPage C. Cost of Services: The work shall be performed for an hourly basis based on the above scope of work with the below estimated total. The initial estimate of this work is approximately $30,000 and AWCK will request written approval prior to exceeding the contract total: Stormwater Engineering Services $ 30,000.00 The Engineer shall invoice the Owner not more than a monthly basis for work performed. The Engineer shall create a new project number and phases for work to adequately provide invoicing information to the Town of Gibsonville. D. Owner agrees to the follows: Payments for services and reimbursables shall be made monthly upon receipt of a statement from AWCK. The Owner shall designate the following as his agent Rob Elliott as being the individual in charge of the project. 3. Conflicts of Interest: Engineer is to limit conflicts of interest with town activities to the maximum extent practicable during the terms of this contract. This includes no private engineering work within the Town limits. F. Designation of Stormwater Administrator: Engineer submits Josh Johnson, P.E. as the designated Stormwater Administrator. Mr. Johnson became licensed as a professional engineer in 2007, has been working in stormwater since 2005, and is certified by NC DEQ for: surface water identification, stormwater plan review, and stormwater control measure inspection. Mr. Johnson is currently on several state stormwater boards including the Jordan Lake Nutrient Scientific Advisory Board where he represents the Town of Gibsonville. G. Additional Services: Both Parties agree that the above represents the terms of the agreement, and should there be material changes in the Project, the provisions and the compensation will be amended accordingly. This agreement is for an exempt project as allowed under G.S. 143-64.32. A. Terms of Service This contract is to run from the execution date through June 30. 2021. It may be renewed by written consent from both parties in 1 year increments after June 30, 2021. The contract may be voided with 60 days notice by either party. 2 1 P a g e B. The above rates are subject to adjustment in accordance with normal salary and rate review practices on an annual basis. g. Where ranges of hourly charge rates are listed, the rate charged will be the actual charge rate associated with the individual performing the services. h.
