Proposed Activity Major Variance Request- Trinity Associates, LLC Surface Water Determination- NBRRO# 13 -223 Project Description 1a. Provide a detailed description of the proposed activity including its purpose: The proposed project includes constructing a 4 -story building and associated infrastructure including parking and stormwater facilities. To accomplish this, the site development proposes to fill 145 linear feet of stream with a 36" Reinforced Concrete Pipe (RCP) and rip -rap outlet protection. This 36" RCP will be an extension of an existing culvert that outlets at the western side of the property. This stream is day lighted for approximately 370 linear feet and then flows back into a 48" RCP at the eastern side of the property. In addition to the proposed culvert, Zones 1 & 2 of the protected riparian buffer adjacent to the 36" RCP extension will need to be filled. Retaining walls will be utilized in order to reach the appropriate site grades for development and to minimize impacts to the stream and buffers. The site plan also proposes 48 parking spaces. The City of Raleigh UDO [Section 10- 2018(a)) requires one (1) space per 300 square feet of building; this would be a total of 46 spaces. The building is designed as a 4 -story structure, this further minimizes the footprint of impacts to the stream and buffers. And finally, the site plan proposes to utilize a Sand Filter system and underground detention to meet the stormwater requirements for the City of Raleigh and the Division of Water Resources. A storm pipe and rip -rap outlet protection is being proposed through the riparian buffer from the Underground Detention. It should be noted that the site is only 1.94 acres in size, and more than 82% of the site is made up of stream and protected riparian buffers, in addition to the required City of Raleigh setbacks and existing utility easements. Total area of buffer proposed to be permanently impacted for the building and parking is 14,595 square feet. Total area of buffer proposed to be Permanently impacted for the storm pipe is 1,005 square feet. An additional 995 square feet of temporary buffer clearing within Zones 1 & 2 for the construction of the retaining walls is proposed. And finally, 235 square feet of grading activity within Zone 2 that is necessary for the construction of the southern -most retaining wall is proposed. All temporary buffer clearing and grading activities within Zones 1 & 2 will be revegetated. Please note: S &EC, PA staff have reviewed and delineated the site and do not believe that any wetlands exist on the subject property. The only jurisdictional waters include the stream that bisects the property. 1b. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re- planting vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of runoff from impervious surfaces, etc.). A level spreader will be installed to achieve diffuse flow of runoff generated by the proposed new impervious surfaces and will be located downstream of a proposed sand filter. A second level spreader will be installed to achieve diffuse flow from two existing storm drainage systems that direct off -site stormwater runoff onto the subject property. Note: The second level spreader will be designed to the current DWR standards and will replace the old /custom designed level spreader (see photo). Both level spreaders will be utilized for diffuse flow only and will be located outside the 50 foot protected riparian buffer. Please note that at this time only the conceptual diffuse flow plan is being submitted to the DWR for review, therefore supplemental forms and O &M Agreements are not included with this submittal. 1a. Show the location of diffuse flow measure(s) on your site plan. 1b. Attach a completed Level Spreader Supplement Form or BMP Supplement Form with all required items for each proposed measure. 1c. Attach an Operation and Maintenance (O &M) Form for each proposed level spreader or BMP. 2. For Major, Catawba, and Goose Creek variance requests, provide a description of all best management practices (BMPs) that will be used to minimize disturbance and control the discharge of nutrients and sediments from stormwater. The site will be graded such that runoff from the proposed development will be collected in a storm drainage system that will direct the first 1" of runoff to a sand filter. Rainfall events greater than the first 1" will be bypassed to an underground detention system. To avoid further buffer encroachment, the sand filter, as well as the underground detention system, will be located under the proposed drive /parking area. The sand filter will be designed to provide removal of nutrients and pollutants generated by the proposed development as required by the NCDENR -DWR. Please note that at this time only the conceptual stormwater management plan is being submitted to the DWR for review, therefore supplemental forms and O &M Agreements are not included with this submittal. 2a. Show the location of BMPs on your site plan. 2b. Attach a Supplement Form for each structural BMP proposed. 2c. Attach an Operation and Maintenance (O &M) Form for each structural BMP proposed. E. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible. This property was subdivided and recorded from a larger tract of land in January 1999 (BK: 1999; Pg: 36). In October of 2005, this property was recombined and reduced in size from 2.03 acres to 1.94 acres (BK: 2005; Pg: 2154). The current property owner purchased this property on June 3 2013. The subdividing of this parcel occurred prior to the effective date of the Neuse River Buffer Rules, August 1, 2000. This property is only 1.94 acres in size. This property is bisected by a perennial stream and since the effective date of the Neuse River Buffer Rules, more than 56% of the property is no longer available for development. The remaining developable land within the property is further minimized by the City of Raleigh's setbacks and existing utilitv easements. This property is zoned Industrial (Ind -1), is surrounded by commercial development and is located at a major intersection. The proposed project is allowed under the existing zoning. The owner believes that he may be able to receive an acceptable return on his investment if the proposed plan is approved. FORM: VAR 10 -2013 Page 5 of 6 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc). _ As stated above the application of the Neuse River Buffer Rule alone deems more than 56% of the property is no longer available for development The property is zoned Industrial and is located in a commercial /industrial setting. The only reasonable development plan for this property would include a building and parking area. 3. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different from that of neighboring property. The property includes a perennial stream that bisects the full length of this rectangle shaped property. The elevation of the property varies approximately 30+ feet from the stream banks up to the existing road bed. In order to develop this property, filling an area and raising the elevation is the only practical way to develop it. Ideally, piping the entire stream and filling the valley makes the most economic sense but that plan would not minimize impacts as much as practicable. 4. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule. The applicant has not violated the Neuse River Buffer Rule. 5. For Neuse, Tar - Pamlico, Jordan Lake and Goose Creek only: Did the applicant purchase the property after the effective date of the applicable Buffer Rule and then request a variance? The applicant did purchase the property after the effective date of the Neuse River Buffer Rule. However the property was subdivided and recorded by a previous owner prior to August 1 2000 the effective date of the Neuse River Buffer Rule. 6. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread. As stated above the application of the Neuse River Buffer Rule alone deems more than 56% of the property as no longer available for development. The property is zoned Industrial and is located in a commercial /industrial setting. We scanned the Wake County GIS website looking for other similar properties with a stream running through the entire length and buffers encumbering 56% of the property and were unable to locate any. Since the time the property was subdivided the municipalities have become more aware of the buffer regulations and typically no longer allow for such subdivisions that would otherwise require a variance to develop. F. Deed Restrictions By your signature in Section G of this application, you certify that all structural stormwater BMPs required by this variance shall be located in recorded drainage easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot.
