9. PROTECT DESCRIPTION
The proposed project is located at 343 Serenity Lane, adjacent to the AIWW, on the eastern end of Holden
Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden
Beach. At the Supply intersection, turn left onto NC 211 S. Travel .3 miles down NC 211 S and turn right onto
Stone Chimney Road SW. Drive down Stone Chimney Road for 5.5 miles and continue onto Old Ferry
Connection SW for 1.1 miles. Turn right onto Sabbath Home Road SW and then take the next left onto NC 130
E towards Holden Beach. Travel over the Holden Beach bridge and left a right onto Ocean Blvd. Continue for
I .l miles and take a Ieft onto Dunescape Drive. Continue 0.1 mile and turn right on Windswept Way. Continue
0.2 miles, turn left onto Serenity Lane, and the project location will be located on the left hand side.
The project site is approximately 1.3 acres and is vegetated on the uplands with domestic grasses and
ornamental landscaping. The high ground portion is elevated approximately I V above the normal high water
(NHW) level, and the shoreline along the AIWW (+/- 100 linear feet) is not currently stabilized. Between the
uplands and the shoreline, there is an expansive area of Maritime Shrub Thicket and 404 wetlands, , spanning a
300'area lengthwise and the 100' width of the property. Along the shoreline, there are coastal wetlands
present, consisting primarily of Smooth Chrordgrass (Spartina Adternijlara), and Black Needlerush (Juncus
Romerianus). Residential properties border the project site to the east and the west side of the property is
bordered by a vacant lot, zoned for residential use.
Existing structures on the project site include a single family residence, and a private two (2) slip docking
facility. The existing docking facility was permitted in February 2021 via CAMA General Permit 778000D
(included in the application materials). The current docking facility is accessed by a fixed access walkway and
pier (6' x 566'). From the terminus of the fixed access pier, a ramp leads waterward to a floating dock (12' x
16') oriented parallel with the shoreline. To the immediate west of the terminus of the access pier there is an
existing boatlift (14' x 14') and on the east side of the end of the pier, there is an existing uncovered fixed
platform (10'x8') and an existing covered fixed platform (13' x 17'). The docking facility currently contains
two (2) formalized boat slips.
The waters of the AIWW are classified SA-HQW by the Division of Water Quality and ARE NOT designated
as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of
shellfish. Based on visual observations made by DCM staff during the site visit, there appears to be NO
Submerged Aquatic Vegetation (SAV) in the surrounding waters.
PROPOSED PROJECT
The applicant proposes to install a second boatlift, increasing the total slip count from two (2) to three (3) within
the AIWW. The applicant is proposing a second boatlift to the immediate east of the existing fixed covered
platform. A boatlift (16' x 16') would extend to the east in alignment with the existing fixed covered platform
creating an additional slip (See Page 2 of 5, Proposed Structures). The proposed boatlift would not encroach
into the eastern riparian corridor setback. The constructed features would increase the slip count from 2 to 3.
According to the applicant, the waterward end of the docking facility would be located in water greater than 5'
at NLW.
1 O.ANTICIPATED IMPACTS
The proposed docking facility expansion would incorporate an additional 256 SF of Estuarine Waters and
Public Trust Area. The docking facility would remain consistent with similar pier length requirements
(established pier -head line). The proposed docking facility would not encroach into the 15-foot riparian corridor
setback of the eastern property owner and no new work is being proposed on the western side of the riparian
corridor. Application materials stated water depths of 5' in the project area, however site visit by DCM Staff
observed 34' * NLW * project area. Minor increases in turbidity should be expected during piling installation.

The applicant is proposing to add a 15,0001b (16'x16') boat lift to his existing docking facility. The
existing docking facility includes a walkway (6' x—566'), a floating dock (12' x 16'), a boat lift (14' x 14'), a
fixed platform (10'ff ), and a covered fixed platform (dripline 13'x17'). The existing docking facility has 2
formalized slips and the proposed boat lift will increase that to 3 formalized slips. The property has
approximately 100' of shoreline. At NLW the most waterward depths of the docking facility are greater
than -5.0 feet.

under the 2020 Section 401 Certification Rule was November 11, 2021. The new complete date is November 4,
2021 due to retraction of this rule. It was received as complete on November 4, 2021 and appears to be adequate for
processing at this time. The projected deadline for making a decision is January 18, 2022. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not been notified of
a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 4, 2021, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application,

State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive

113A-119(b) that the following applications were submitted for a development permits in Areas of
Environmental Concern as designated under the LAMA: On November 18, 2021, Stoked on the
Water, LLC (c% Jeff Stokley) proposed to construct a new bulkhead water ward of the existing
failing bulkhead and reconfigure & expand existing deck to include a new rooftop deck at the
existing commercial waterfront restaurant at 313 Canal Dr., adjacent to the Carolina Beach Yacht
Basin in Carolina Beach, New Hanover County, On November 18, 2021, Victoria Detweiler
proposed to remove and reconstruct an existing docking facility to include five (5) slips and a
gazebo at 36 Pelican Dr., adjacent to Lee's Cut in Wrightsville Beach, New Hanover County; And
on November 17, 2021, Nicholas & Deirdre Sarif proposed to install a second boadift, increasing
slip count from two (2) to three (3) at 343 Serenity Ln., adjacent to the AIWW in Holden Beach,
