Dear Mr. Kilpatrick:
The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
The Division understands that you have made no significant alterations to your wastewater treatment
facilities during the previous permit cycle. Based on your renewal application received March 13, 2010, we
have therefore made only minimal changes to your permit by updating your facility map, treatment -
component description, and adding parameter codes to the effluent monitoring page. We have also added a
footnote regarding compliance to Total Residual Chlorine [see Section, A. (1.)].
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.

may require permit modification, or revocation and re -issuance. Please note that this permit does
not affect your legal obligation to obtain other permits required by the Division of Water Quality,
the Division of Land Resources, the Coastal Area Management Act, or other federal or local
governments.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,

is hereby authorized to discharge wastewater from a facility located at the
Mountain Valley Subdivision WWTP
NCSR 1171
east of Etowah
Henderson County
to receiving waters designated as the French Broad River in the French Broad River Basin, in accordance
with effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV
hereof.
This permit shall become effective July 1, 2011
This permit and authorization to discharge shall expire at midnight on November 30, 2015.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to pperate and discharge from this facility arises under the,
permit conditions, requirements, terms, and provisions included herein.
Veolia Water North America
is hereby authorized to:
1. continue to operate an existing 0.024 MGD extended -aeration wastewater treatment plant (WWTP)
to treat 100 % domestic wastes, consisting of:
• aeration basin
• clarifier
• sludge holding basin
• chlorine -contact chamber with tablet chlorination
• dechlorinator (tablet)
• effluent flow meter
• sludge -holding basin
located east of Etowah at Mountain Valley Subdivision, off NCSR 1171, in Henderson County, and
2. after applying for and receiving an Authorization to Construct permit from the Division of Water
Quality's Construction Grants and Loans (CG&L), construct additional facilities to increase plant
capacity up to 0.040 MGD, and after submitting to the Division an Engineer's Certification Form,
3. discharge from said treatment works, at the location specified on the attached map, into the French
Broad River [stream segment 6-(47.5)], a waterbody currently classified WS-IV, B within subbasin
04-03-02 of the French Broad River Basin.

2. Total Residual Chlorine (TRC) monitoring is required only if chlorine is used by the facility for
primary or backup disinfection. Because of difficulty quantifying TRC in a wastewater matrix, the
Division will consider all North Carolina -certified test -method values reported below 50µg/L to be
compliant with this permit. However, the Permittee shall continue to submit all values reported above the
test -method minimum detection limit, even if these levels fall below 50µg/L, and use these actual values
when calculating averages, if any.

A. (3.) ENGINEERING ALTERNATIVES ANALYSIS (EAA)
Prior to constructing additional facilities, the Permittee shall submit a letter justifying the need for
additional flow. The Permittee shall also prepare an Engineering Alternatives Analysis (EAA) to
evaluate surface discharge alternatives, in compliance with the Division's guidance document for
EAA's, to include the feasibility of a non -discharge system on adjacent property.

Please consider this a request for renewal of the subject NPDES permit. A completed Short
Form D (the original and two copies) is enclosed. There have been no changes made to the
facility since the last renewal.
Sludge generated at the WWTP is pumped and hauled by a commercial hauler (Goldie and
Associates) to a Class IV facility (the City of Hendersonville WWTP) in Henderson County for
additional treatment and final disposal.

Sludge Management Plan

Mountain Valley Subdivision WWTP
Sludge generated at the Mountain Valley WWTP is pumped and hauled by a commercial hauler
(Goidie and Associates) to a Class IV facility (the City of Hendersonville WWTP) in Henderson
County for additional treatment and final disposal.

issued Notices of Violation in 2006 (February and September), and again in 2010 (January and
November) for TSS, Fecal Coliform, and TRC — none proceeded to assessment (see attached
