Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). No later than one year following the effective date of this permit, effluent disinfection shall be provided. Fecal limits of 200/100 mL (monthly average) and 400/100 mL (daily maximum) will apply at this time. This change is in response to the proposed reclassification of the French Broad River to protect for uses such as swimming. (Refer to A. (1.) and A. (2.)). If additional wastewater treatment facilities need to be constructed, an Authorization to Construct permit is required. Prior to expansion, the permittee is required to submit a letter of justification to show that the additional flow is needed and that a non -discharge system on the adjacent property is not feasible. (Refer to A. (3.)). An Engineering Alternatives Analysis (EAA) shall be prepared in compliance with the Division's guidance document (enclosed). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. First, The name listed as the permittee needs to change back to Hydrologic Inc. Apparently, the facility was for sale and it appeared that Blue Mountain Utility would purchase the facility. However, that is not going to happen and the owner will continue to be Hydrologic Inc. Second, He commented on the fecal limit you placed in the permit. The fecal limit becomes effective in 2002, in the interim, there is a requirement to monitor fecal coliform. Currently, the facility has no disinfection therefore, the ORC was unsure why they would be required to monitor fecal coliform. He did not see the usefulness in that data since they do not disinfect. I told him I would talk to you about and that one of us would contact the facility. He asked that we contact Tom Kilpatrick at 3-800-231-8889. If you would like to discuss this let me know. A report submitted to the Planning Branch in April 2000 recommends reclassification from class IICII to class IIBII waters for several of these rivers, documenting the extensive recreational use in these mountains streams. Of these rivers, the French Broad River and Bent Creek have permitted NPDES dischargers that do not disinfect their wastewater. In addition, several dischargers are not required to monitor up and downstream of their discharge. To protect the existing swimming use in these rivers, the Asheville Regional Office is requesting that the NPDES group review the following facilities whose permits are up for renewal and require Fecal Coliform effluent limits as well as upstream and downstream monitoring. Please refer to page 16 of 15A NCAC 2B.0500 regarding monitoring requirements in all appropriate situations. Also note that the classes of facilities are provided on the attachment. Notification has been sent to these facilities to inform them of the coming permit changes. We will work with the NPDES group to develop compliance schedules. If a Henderson County facility is not mentioned in this memorandum it should be sent along the fast track (1) NC0024431 - Kanuga Conference Center. Permit should be worded so as to allow water well meter readings to suffice for wastewater flow data. (2) NC0036641 - Fletcher Academy has requested an increase in allowable flow to 140,000 g.p.d. without plant modification. As they are already having effluent limit violations, I recommend against the requested flow increase until we can be assured that Fletcher Academy has a system which can comply at a flow of 140,000 g.p.d.. (3) NC0037176 - Bon Worth; can we reissue the permit with a flow of about 2,000 g.p.d., thereby avoiding either an ammonia limit or toxicity monitoring? The world would be a better place if this facility were placed under a no hassle general permit. (6) NC0039721 - Bonclarken, this plant may be taken out of service in the next few months as a result of municipal sewer construction. (7) NC0069949 and NC0056928 - Kenmure, these two systems will probably be taken out of service in the next few months as a result of municipal sewer construction. (8) NC0032140 - Flat Rock Playhouse, this system will probably be taken out of service in the next few months as a result of municipal sewer construction. (9) NC0076082 - Bear Wallow Valley Mobile Home Park, as far as I am concerned the permit can be reissued in its present form for this existing system. A completed Short Form D is enclosed. To my knowledge, there have been no significant changes made to the facility since the last renewal. This renewal application is late for the following reasons: 1. The current permit is in the name of Hydrologic, Inc. - a previous owner; 2. Culligan Operating Services obtained this unit and the franchise from the NC Public Utilities Commission (PUC) circa the 1994, '95, '96 time frame. Apparently, the name was never changed on the permit. Therefore, the mailers for permit renewals were not received. 3. Blue Mountain Utilities began operation of this unit in January, 1999 under an Interim Operating Agreement with Culligan Operating Services. Blue Mountain Utilities has intentions to acquire this unit contingent upon approval from PUC. Blue Mountain Utilities is attempting to get Name Change forms from Hydrologic, Inc. Hydrologic appears willing to sign the forms but they have not arrived in this office at this time. Since the Permit renewal applications must be postmarked by June 3, 2000, I am sending these today. Name Change forms will be forwarded upon arrival. Sludge generated at this facility is pumped and hauled to a Class IV facility in Henderson County for additional treatment and final disposal.
