Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or
as subsequently amended).
The following modifications in the November 10, 2010 draft permit remain in the final permit:
• Footnote #1 has been modified to include new Total Residual language.
• Footnote #2 has been deleted.
• Addition of Influent Monitoring for
• BOD, 5-day and NH3 as N
During the past five year permit cycle there have been numerous incidents of noncompliance.
Consistent and reliable operation of this site will allow the facility to reduce/eliminate the occurrence
of these noncompliance events and maintain compliance with the permit.
Please note that Mud Creek is listed as an impaired waterbody on the North Carolina 303(d)
Impaired Waters List. Addressing impaired waters is a high priority for the Division, and
instream data will continue to be evaluated. If there is continual noncompliance with your
effluent limits, or if stream impairment can be attributed to your facility's discharge, mitigative
measures may be required.

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required. If you have any questions concerning

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this
number is no longer effective. Therefore, the exclusive authority to operate and discharge
from this facility arises under the permit conditions, requirements, terms, and provisions
included herein.
Nathan Benson is hereby authorized to:
1. Continue to operate an existing 0.008 MGD wastewater treatment facility with the
following components:
• Septic tank/flow equalization tank (6,000 gallons)
• Manual bar screen
• Extended aeration basin (8,250 gallon)
• Dual blowers providing diffused air (52 cfm each)
• Rectangular clarifier with skimmer and sludge return (1,639 gallon)
• Aerobic digestor (1,400 gallon)
• Hypochlorite tablet chlorinator
• Chlorine contact chamber (800 gallon)
• Sodium sulfite tablet dechlorinator
• Effluent pump station with high water alarms
• Portable stand-by generator
2. This facility is located at the Benson Apartments WWTP, on 161 Brookside Camp
Road, Hendersonville, in Henderson County.
3. Discharge from said treatment works at the location specified on the attached map
into an unnamed tributary to Mud Creek, classified C waters in the French Broad River
Basin.

Dear Mr. Guerra,
As you are aware from previous correspondance by James &
James Environmental,this facility has been experiencing an
influent from a toxic source.Originally,James & James brought it
to our attention that every other weekend our Ammonia Nitrogen
analysis would spike sometimes 15 times our permit limit.After
both mechanical and chemical adjustments,the facility would
regain compliance just in time to have another spike hit the system.
We began an investigation of our own,first sending out
correspondance dictating the type of cleaning products that they
could use that would suit our wastewater facility.We also reminded
our tenants that they were to dispose of grease in the waste
container rather than the sink.Second,we installed a tank upstream
of the wastewater facility to catch and solidify any grease and
oils that the tenants did wash down the sink to keep them out of
the aeration basin.Next,after process of elimination,we began to
question our tenants of any odd behavior in the complex. We found
a few tenants that reported increased traffic on certain days
around a certain building.We contacted the DEA of Henderson County
and they began to conduct regular drive through visits of the
complex,but stated until we had more proof they could do little
else.We,along with James & James,did a door to door visit to
each tenant,handing out another list of adequate cleaning products
and doing a visual and "smell" test of the a artments.We located
one apartment that invited us in to "smell" the odors coming
from the duct system.James & James contacted the DEA with this new
in dormation and worked very closely with the inspector.The
Sheriff's Department sent out an officer on two seperate occasions
to give a stronger police presence.This,along with our and James
& James physical presence on site,caused the suspected tenant
to move out of the apartments.Since that time,we have been in
compliance each week for Ammonia Nitrogen.

Another point I would like to mention,James & James requested
a technical assistance review from Asheville Regional Office to
receive ideas of how to combat this influx of strong chemicals.
They reported that the facility was antifreeze green,that the
facility had been 90 percent pumped and reseeded on two seperate
osscations and regularly had dead solids removed,and all of the
additional chemical additions and testing had occurred.They were
told that we would have to wait at minimum 6 months for the
technical assistance.From our perspective,the need for assistance
was rather evident and should have been conducted soon after the
request.We investigated how we could conduct Ammonia Nitrogen
samples from specific complexes,but several are tied into the
same collection line upstream of the available manholes.This would
give us little information.James & James conducted alkalinity
testing which reveled a good result just prior to being "dumped on"
and a negative result after.
We believe that we did all humanly possible to combat the
toxic influent entering our facility.There are legal means that
one can use to searchout issues in a public complex such as this one.
Unfortunely,this process moves slowly.This facility,until this
time,operated rather well and since the resident moved out has
operated very well again.
We would request the renewal of our permit.Many families
depend on this housing,and we believe are very conscientious as
to the operating condition of this facility.Our service company
is very devoted to the proper operation and goes above and beyond
to assist us with public notices and anything that should not be
in the influent.
