stream, treatment process or outfall location. The Division may not be able to process the Permit
Name/Ownership Change request and may require that the new owner file a new permit application.
THIS APPLICATION PACKAGE WILL NOT BE ACCEPTED BY THE DIVISION UNLESS ALL OF THE
APPLICABLE ITEMS LISTED BELOW ARE INCLUDED WITH THE SUBMITTAL.

and is accurate and complete to the best of my knowledge. I understand that if all required parts of this
application are not completed and that if all required supporting information and attachments are not
included, this application package will be returned as incomplete. I understand that Permit Name/
Ownership Change can only take place through action taken by the Division of Water Resources and
that no actions on my part or the part of my company result in the automatic transfer of permit
coverage.

Dear Mr. Allen:
The referenced property has been referred to the State of North Carolina Underground Storage
Tank (UST) Trust Fund Branch, State -Lead Program. According to the available information, this
property was used as a gas station. While operated as a gas station there were two sets of USTs
located in separate areas of the property; one set of tanks were removed in 1972, and the second
set of USTs owned by Foust Oil Company, Inc. (dissolved) were removed in 1989. Based on the
assessment performed releases occurred from both former UST areas. A remediation system was
installed and operated from 2016 to 2019. Based on the reported information the remediation
system was effective in reducing the footprint of the groundwater contamination, however,
groundwater contamination remains in excess of the NC 2L Standards. In addition, an onsite water
supply well has been reported with petroleum contaminants also in excess of the NC 2L Standards
and US EPA drinking water standards.
Due to the documented presence of residual contamination of groundwater and possibly soils at
the referenced property, further assessment and possible further remediation may be necessary.
Based on the information available, you, as the current owner of the property would not be

considered the owner or operator of the tank(s), and therefore, not responsible for the release
associated with the original USTs in accordance with G.S. 143-215.94A.
To determine the risk posed by the contamination at the subject property, the UST Section needs
to access to the property to take all reasonable and necessary action(s) to conduct assessment and
remedial activities necessary to protect human health and the environment. Please sign the attached
site access agreement letter and return it to the address indicated on the letter. Please understand
that failure to allow access to the property could potentially make the property owner responsible
for cleanup under other State and Federal regulations. You will be notified when assessment and/or
remedial activities begin.
