On behalf of the City of Durham, Kimley-Horn is submitting this pre-filing meeting request for a section of the proposed
Northern Durham Parkway project located in Durham, Durham County, NC. The proposed section would extend from
Ferrell Road south to Cheek Road. The typical section of the proposed roadway would consist of a 2-lane road with curb
and gutter and a sidewalk facility. The project will be constructed through the proposed Junction Road and Ferrell Road
industrial development and the road will be built in phases. Phase I will extend from Ferrell Road south to a point north of
Panther Creek and Phase II will extend from Phase I south to Cheek Road. The project is aligned to tie into previously
dedicated right-of-way on both the north and south termini. The project is located within the Neuse River Basin (03020101).
Stephanie Goss (NCDWR) conducted a field review to determine which streams in the project area are subject to the
Neuse River Basin Buffer Rules and to identify isolated wetlands that may be subject to State regulation on March 8,
2021(NBRRO #21-004). Additionally, April Norton (USACE) issued a Preliminary and Approved Jurisdictional Determination
for the covering the proposed roadway on April 9, 2021. A pre-app meeting was conducted with April Norton, Sam Dailey
(USACE), and Andy Williams (USACE) to discuss the project permitting approach. During this meeting, it was determined
that the stretch of Northern Durham Parkway that is to be constructed through the proposed Junction Road and Ferrell
Road site would be considered a separate project from the industrial development and would need to be permitted by the
City of Durham under a separate permit application.
Phase I of the proposed roadway will result in unavoidable impacts to two 404/401 wetlands, three intermittent streams,
and multiple buffer zones. All three stream and buffer crossings are proposed to be near perpendicular. Phase II, which is
still in design and would be constructed following completion of Phase I, would result in unavoidable impacts to Panther
Creek, floodplain wetlands along Panther Creek, and associated buffer zones. It is anticipated that impacts resulting from
Phase I of the NDP project will qualify for authorization under Nationwide Permit #14 and corresponding Water Quality
General Certification 4135. Additionally, the project will require a Riparian Buffer Authorization for impacts to buffer zones 1
and 2.
