Inspection Summary:
Site visit confirmed location is a previously timbered area with no prior excavation/mining
The following comments regarding the NOI application were provided via email to Central Office staff on September 21,
2021:
• I spoke with the consultant listed on the NOI, Greg Wayne, on 9/15/2021 to discuss the proposed mining activity and
information in the application.
• According to Mr. Wayne, the mine site will be approximately 3 acres of excavation with no further processing of materials.
Simply dig and haul away.
• The listed receiving waters, Boggy Branch, actually has a classification of C;Sw:+ where the + symbol identifies waters
subject to a special management strategy specified in 15A NCAC 2B .0225 the Outstanding Resource Waters rule. In
reviewing that rule, it states that for freshwater ORWs: "No new discharges... shall be permitted..." I believe this is referring to
wastewater discharges, but I'm uncertain how this pertains to mine dewatering, which is proposed in the NOI. It should be
noted that according to the NOI and the consultant, mine dewatering and stormwater will enter a proposed sediment basin
and sediment trap where the water may infiltrate or possibly "discharge" from the basin/trap into a vegetated area. I've never
encountered this situation before regarding a mine being adjacent to waters with the + symbol as part of its classification, so
I'm not sure how we handle that when it comes to issuance of NCG02 permit coverage. Hence, I've cc'd Annette, Bethany
and Toby for their input.
• The NOI indicates that there are wetlands within 50' of the mine pit perimeter. Since they are proposing mine dewatering, I
relayed information to the consultant regarding a Pumping Operation and Monitoring Plan. It's my understanding that staff
with DWR have been to the site regarding the wetlands, but I do not know the outcome of their visit.
• There are to be no ASTs on the site, which is why the NOI is marked No concerning secondary containment.
• The lat/long listed on the NOI for the stormwater outfall appears correct. The lat/long for mine dewatering should be the
same (-78.5164 instead of-78.6164 as entered on the NOI).
Based on the site location being within an ORW Special Management Strategy Area Watershed, no mine dewatering (as
proposed in the NOI) or other process wastewaters can be discharged from the site. If coverage under the NCG020000
permit is issued, it should be for stormwater discharges only.
