SUBJECT: NOTICE OF VIOLATION

Dear Mr. Blount:
The North Carolina Division of Water Resources conducted an inspection of the Creswell WWTP on November
10, 2021. This inspection was conducted to verify that the facility is operating in compliance with the conditions
and limitations specified in NPDES WW Permit No. NC0048861. A summary of the findings and comments noted
during the inspection are provided in the enclosed copy of the inspection report.
The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Washington
Regional Office. The following violations were noted during the inspection:
Inspection Area Description of Violation
Permit
Condition A. (2) of the NPDES permit required a staff gauge to be installed in the lagoon
by September 30, 2018. On the day of inspection the staff gauge had not been installed. A
staff gauge shall be installed no later than March 1, 2022 so weekly freeboard levels can be
recorded.
Effluent Sampling
On the day of inspection there was not a thermometer in the refrigerator. A thermometer
needs to be maintained in the sampler to verify that the refrigerator temperature is
below 6 degrees C.

Inspection Area Description of Violation
Influent Sampling
On the day of inspection there was not a thermometer in the refrigerator. A thermometer
needs to be maintained in the sampler to verify that the refrigerator temperature is
below 6 degrees C.
Record Keeping Ryan Swain is the ORC with no backup ORC. The Town of Creswell needs to designate a
Backup ORC.
Permit
A groundwater well is located beside the influent pump station. Special Condition A (2) in the
NPDES permit required the well to be abandoned by October 31, 2018. On the day of
inspection the well had not been abandoned. The well shall be abandoned no later
than March 1, 2022.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law.
To prevent further action, please respond in writing to this office within 30 days upon your receipt of this Notice
of Violation regarding your plans or measures to be taken to address the indicated violations and other identified
issues, if applicable.
