PROJECT SUMMARY: The proposed project is a major modification to existing major permit # 157 -09 and includes the addition of seven new slips with boatlifts, three new finger piers and additional dredging. The original project was previously permitted through the major permit (157 -09) for a 10 -slip marina with dredging and bulkhead however, the high ground was not included with this due to the fact that it was previously permitted through minor permits 20 -06 and 15 -06. Discussions with the applicants and DWR (DWQ formerly), it was determined that the February 7, 2013 upland development proposal would need to be permitted through the major permit process. A major modification was issued on 5/20/13 for the upland development which included a six lot low density subdivision, riprap shoreline stabilization, boardwalks and all required infrastructure (electric, roads, water etc). 9. Narrative Description The Turner Westward LLC and Taylors Creek Holdings commercial project is at 501 and 513 Turner Street in Beaufort, Carteret County and is adjacent to Town Creek and the USACE Federal Harbor Turning Basin as well as the Town of Beaufort Harbor Line. The high ground property (two tracts) is 1.3 acres (56836 sf) in its entirety and is an average of 4' -5' above NHW. The property is partially developed with a new foundation on the Taylors Creek Holdings parcel and existing building debris with driveways, new common drive for the subdivision and riprap along the shoreline on the other parcel. The existing riprap consists mainly of relic broken masonry debris, at and below nhw along the shoreline. There is a sloping escarpment along the shoreline as well as scattered fringes of coastal marsh waterward of the existing riprap. The coastal wetlands consist of Spartina alterniflora (Smooth Cordgrass). The high ground is comprised mostly of grasses, a few cedars, oak trees, holly trees and scrub bushes. There is an undeveloped residential property to the north with a public street right of way to the south. The Town of Beaufort's Land Use Plan classifies this property as Low Density Residential with all AECs classified Conservation. Town Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. Town Creek within this area carries a water classification of SC and is approximately 783' wide. Riparian corridors were determined through the previous major permit 157 -09. Substrate is silty sand. No SAVs or shellfish beds were observed within the riprap proposal area. A shellfish survey was conducted for the original major permit on 10/9/09 due to DMF concerns with the proposed dredging area. The proposed dredging footprint from the 2009 proposal incorporated approximately 81,033 square feet of shallow bottom habitat. Due to the concerns raised by DMF, this was reduced to approximately 48,817 square feet and the slip areas were reconfigured to the be located on the north side of the platform and the western side of the pier. Once the proposal was changed, DMF removed their denial recommendation. Field Investigation Report Turner Westward, LLC and Taylors Creek Holdings Page 03 10. Project Description: The current proposal is for the addition of seven new slips, which would be located on the east side of the previously permitted pier, for a total of 17 (ten existing and seven new). They are also proposing seven 12' x12' boatlifts, three 3' x 28' floating finger piers and approximately 11,725 square feet of additional dredging to the east. Due to the shallow water depths within this area the applicant is proposing additional dredging that was not previously permitted to help accommodate the new slip proposal. They are proposing a total of 11,725 square feet of additional dredging along the east side of the permitted pier and platform. The new dredge area would be 60' x 145' and would not exceed a maximum of -4' nlw. A total of 1,031 cubic yards of material would be removed from the system. The connecting water depths within this area are an average of — 5.32' nlw. Per the applicant, the spoils would be removed by the contractor and placed on a DCM preapproved site. The applicant is proposing the addition of seven new slip areas along the east side of the previously permitted pier. They would start at a distance of 90' waterward of normal high water. The seven slips would be located landward of the previously permitted platform. There would be a total of three 3' x 28' finger piers for the seven new slips. The finger piers would be located between slips 2 and 3, 4 and 5 and 6 and 7. Each of the slips would have a 12' x 12' boatlift installed. The lifts would be located a distance of 16' from the pier in order to accommodate for the bow of the boat. All parts of the boatlifts would remain within the slip footprint. The existing water depths within this area are an average of — 2.1' nlw. The typical boat using the marina would be 30' with mixed types such as sail, charter, yachts and sports fishing. The marina policy would prohibit overboard discharge with no overnight or live aboard dockage and would be equipped with a pump out and signs that were previously permitted. The width of Town Creek within this area is 783'. All portions of the new slips, fingers and boatlifts would remain landward of the previously permitted platform. All parts of the development would also be 15' from the riparian corridors. 11. Anticipated Impacts: The proposed slips, boatlifts and fingers would shade 252 ft2 of estuarine bottom and incorporate 2,520 ft2 of Public Trust open water. The maintenance excavation for the proposed marina reconfiguration would disturb 11,725 ft2 of shallow bottom habitat and remove a total of 1,031 cubic yards of material from the system. There is a possibility of future dredging, but no long term effects are anticipated. The setting of pilings and excavation has the potential to cause a temporary increase in turbidity during construction and excavation activities. No coastal marsh would be filled or excavated during this project. Due to past shellfish surveys conducted in this area there is the potential for disturbance to this habitat from the proposed dredging. There is no encroachment within the Federal Basin and Town of Beaufort Harbor Line.
