(S &ME) is submitting this permit application for impacts to waters of the U.S. in accordance with North Carolina Division of Water Resources ( NCDWR) Water Quality Certification (WQC) 3890. The project received written authorization from the U.S. Army Corps of Engineers ( USACE) for proposed impacts to waters of the U.S. under Nationwide Permit 29 (Action ID 200501193) in 2008 and 2013. We were informed by the applicant that NCDWR personnel informed them that written notification to NC Division of Water Quality per WQC 3890 was not required in 2008 as wetland impact totals were below the notification threshold of 0.2 acres; however, that WQC expired in March 2013 and general conditions of the current WQC reduced the notification threshold to 0.1 acres of wetland impact, which this project proposes to exceed. The applicant for the project will be Rocky Point Properties, LLC. Withers & Ravenel had provided wetland delineation and Section 404 permitting services prior to our involvement in the project. A Notice of Jurisdictional Determination (JD) dated February 9, 2006 was provided and has been included. The JD was updated JD in January 2011 but a copy of that has not been provided to S &ME. The re- issued USACE NWP 29 Verification dated March 13, 2013 has been included which references the updated JD. The proposed project involves the development of a 46 -lot residential subdivision. This application includes 0.158 acres of riparian wetland impact associated with roadway crossings. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Approximately 4.05 acres of wetland have been avoided. The main entrance is proposing to cross a wetland at an area that contains an upland pass to minimize impacts. Additional impacts in lot 33 and 38 have been avoided by use of an elevated pedestrian walkway that can be used to access the rear portions of those lots which have been separated by wetland from the rest of the lot. Roadway crossings have been designed to be done at, or dose to 90- degree angles Proposed impacts are only for roadway access. No impacts for lot fill or stormwater management have been proposed. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Sift fence and other sedimentation and erosion control measures shall be employed to minimize unintended impacts resulting from erosion following rain events. Vegetated swales will be used for stormwater treatment and conveyance. Recorded restrictive covenants have been proposed to maintain the wetland conservation areas.
