Thank you Andrea. In regards to your question, it was determined that settling of fill material
on the left bank had reduced channel depth at this specific location, which allowed below
bankfull discharge flows onto the left floodplain. Consequently, shear stress was reduced
through the channel cross-section in this specific location which led to excessive deposition of
sediment in the footprint of the transverse bar. The section of the left bank that settled,
resulting in a lower channel depth, will be raised during repairs to reestablish a channel cross-
section that is adequate to transport the sediment supply (i.e. it will be constructed to the
original design depth). Let me know if you have any further questions.

Yes, as the site is unstable, we will allow repair work to occur within the trout
moratorium between now and January 31, 2022. To lessen impacts to downstream
trout reproduction and hellbender habitat, we ask that particular attention be paid
to sediment and erosion control. Disturbed areas should be stabilized at the end of
each work day, and flows should be diverted around instream work areas.
The one design question we do have is whether simply mining the material out of
the transverse bar is sufficient - is there a foundational geomorphological issue that
will result in the same deposition with the next big storm? If so, can that be
addressed within the mitigation project footprint?

Hey Andrea,
I am writing to request a waiver to conduct instream work during the trout moratorium at
the Owen Farms site for purposes of completing stream repairs on West Fork French Broad
River (see attached Repair Plan Letter). Repairs are necessary due to damage that was
caused by multiple large storm events in August 2021. We have selected a contractor to
complete repair work and they are planning to mobilize to the project in early December to
begin grading work. In stream work will consist of the following:
• re -grading stream banks to restore proper dimension and stabilize eroding banks
• installation of toe wood/soil lifts
• temporary diversions will be constructed using jersey type barriers to route
primary flow away from our work area (this is the same method we used during
original construction work)
Several scour holes in the floodplain will also be filled as part of repair activities and
disturbed areas will be replanted. Natural Balance Contractor, LLC will complete repairs
(the owner of this company was the equipment operator who built the job originally). They
anticipate beginning work in early December and completing grading work by December
31, 2021. In order to account for potential weather/holiday related delays, I am requesting a
waiver to conduct in -stream work through January 31, 2022. If you are in agreement with
