Dear Ms. Beckwith:
The Nortli Caroliva Department of Transportation (NCDOT) is in the pi•ocess of widening the
subject road. Due to a mistake in the plan sheets, it will be necessary fa� NCDOT to buy
additional right of way and permanent di�ainage easement in order to construct the fiill roadway
typical fi•an Sta. 283+00 to Sta. 286+75. The project �vill require the placement of a spriiig box
and drain liue iu au unnamed tributaiy to Byers Creek uuder the new fill slope line fi•oui Sta.
284+00 to Sta. 284+35.
I am enclosing a revised sh�eam impact sheet for the PCN application, a permit drawiug, and
USGS quad map showing the locatiai of the spring liead (Permil Site 3A). In addition, I have
included the "revised" EEP mitigation acceptance letter for stream impacts and copies of the 404
and 401 Permits associated with this project.
Tlu�eatenecl aud �udai�gered Species
A State Euvironmeutal Assessment (SEA) was prepared for this project in September 2008 and a
Pinding of No Siguificant Iuip�ct (FONSI) was sigued iu March 2009. There are six federally
listed species tUat are known to occur fi•om Hendersou Couuty and aie that is believed to liave
occurred tliere historically. There are no records of lhreatened or endaugered species for the
Byers Creek watershed and Mud Creek downstreaui of the confluence �vith Byers Creek.
Tlie projeet is being bt�ilt along the existing road alignment that is already disturbed eacept for
several slight realigmnents. BMP's ���ill Ue implemented to control erosion aud sedimentation
diiring cousU�action and ���ater will be diverted during pipe iustallatious to prevent sedimeutation

of downstream habitats. Based upon tlie SEA and FONSI, NCDOT believes this project should
l�ave "�io effect" on tlu•eatened and endaugered species.
Historic Aj•ciiitectiu•e aud Archacolo��
Tliis project has been surveyed a�id reviewed for historical arcliitectural and arcl�aeological
resources by the NCDOT Human Environment Unit and approved by SHPO. The conclusion of
the snrveys was that the project would have "no effect" ou any siguificant archeological or
historical architecturalresources.
Iny�acts to Wnters of the United States
Tl�e spring head and unnamed tributary to Byers Creek at Site 3A flo�vs lpproaimately 600 feet
to Byeis Creek. From the coniluence witli this uunamed tributairy, Byers Creek flows
approximately 1.7 �uiles to Mtid Creek. Mud Creek tlten flows �ppro�imately 2.3 uiiles to tlie
Freiich Broad River. The French Broad River meets the definition of a Traditional Navigable
Water. For these reasons, we believe that the uunamed tribtita�ry at Site 3A is a Relatively
Permaneut Water and is under the jurisdiction of the U.S. Army Corps of Engineers. Li order to
complete constructiou of tl�is project, it �vill be necessaiy to impact waters of the United States in
the French Broad River Basiu (HUC 06010105). NCDOT is reqiiesting modifieation of the
siibject perinit to iuclude an additiaial 35 linear feet of permanent sh�eam impact for tlie
iustallation oY a spring box and under draiu line at Sta. 284+00 to Sta. 284+35. We also request
100 linear feet of temporai�y� sh•eam impact for tl�e installation of au imperious dike aud flow
diversion in order to install the spring bo� and under drain in the "diy".
The best management practices will be used to minimize and control sedimentation and erosion
on this project The project inspectors �vill�review all sedimentatiou control measures duriug
iustallation to ensure sedimentation is controlled effectively. lf tlie plaiuied devices are not
fimctiouing as iutended, dtey will be replaced iiumediately witl� better devices. The
sedimeutation control devices �vill be in place prior to constructiou and will remain in place until
die project is stabilized.
Permits Requested
NCDOT is hereby requesting �utliorization under Section 404 of tlie Clean Water Act for the
construction project oudined above. B}� copy of tliis letter, I am asking Mr. David McI Iem}�,
Mou��taiu Regiai Coordinator, of the North Carolina Wildlife Resources Commission
(NCWRC) to conuuent directly to you concerning die 404 Nation�vide Permit "Modification"
request.
I am also reqaestiug authorizatioii under Section 401 of the Clean Water Act Il�om tlie North Carolina
Department of Environmeut and NThu�al Resources (DENR), Division of Water Resources (DWR). In

2011), including the environmental commitments made in the application letter. After reviewu�g your application, we
have decided that these impacts are covered by General Water Quality Certification No. 3820, corresponding ro the U.S.
.Army Corps of Engiueers Regional General Permit Numbers 14. In addition, you should acquire any other federal, state
or local perniits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supp]y Watershed regulations. .
This approval is valid solely for the purpose and design described in your application (unless modified below). Should
your project change, you must notify the D WQ and submit a new application If the property is sold, the new o�vner must
be giden a copy of this Certification and approval letter, and is thereby responsible for complying with all conditions. If
total wetland fills for this project (no�v or in the future) exceed one acre, or if total impacts to streams (now
or in the fuh�re) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506

Coudition(s) of Certification:
1. There shall be no excavation from, or waste disposal into, jurisdictional wetlands or waters associated �vith this peimit
without appropriate modification. Should waste or borrow sites, or access roads to waste or borrow sites, be located
in wetlands or streams, compensatory tnitigation will be required since that is a direct impact from road construction
activities.
2. Sedintent and erosion control measures shall not be placed in �i�etlands or waters unless othenvise approved by this
Certification.
3. Erosion and sediment control practices must be in full compliance with all specifications goveming the proper design,
installation and operation and maintenance of such Best Mauagement Practices in order to protect surface waters
staudards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and

8. Unless othenvise approved iii this certification, placement of culverts and other struchires in open �vaters a��d
streams shall be placed below the elevation of the streambed by one foot for all culveits with a diameter
greater than 48 uiches, and 20 percent of the culvert diameter for culverts having a diameter less than 48
inches, to allow low flow passage of water and aquatic life. Design and placement of culverts and otlier
stivchues including tempora�y erosion conhol measures shall not be conducted in a ma�mer that may result u�
dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above
structures. The applicant is required to provide evidence that the equilibrium is being maintained if requested
in writing Uy NCDWQ. If this condition is unable to be met due to bedrock or other limiting feamres
encountered during construction, please contact NCDWQ for guidance on how to proceed and to detennine
wl�ether or not a pe�mit modification will be required.
9. If multiple pipes or barrels are required, they shall be designed to mimic natural sh�eam cross section as closely as
possible including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the sheam
chamiel should be avoided. Stream channel widening at the inlet or outlet end of structures rypically decreases water
velocity causing sediment deposition that requires increased maintenance and disivpts aquatic life passage.
10. All work in or adjacent to stream waters shall be conducted in a dry work area. Approved BMP measures from the
most curre��t version of NCDOT Construction and Maintenance Activities manual such as sandbags, rock beims,
cofferdams and other diversion shuctures shall be used to prevent excavation in flowing water.
11. The sheam chaimel shall be excavated ��o deeper than the natural bed material of the stream, to the maximum extent
practicable. Efforts must be made to minimize impacts to the stream banks, as well as to vegetation responsible for
maintaini��g stream barilc stabiliry. Any applicable riparian buffer impact for access to stream chamiel shall be
tempora�y and be revegetated with native riparian species.
12. Strict adherence to the most recent version of NCDOT's Best Manageme�t Practices for Bridge Demolition and
Removal approved by the US Army Coips of Engineers is a condition of the 401 Water Quality Ceitification.
13. The dimension, pattern and p�nfile of the stream, above aud below the crossii�g, shall not be modified. Dishirbed
floodplains and streams shall be restored to natural geomorphic conditions.
14. Native riparian vegetation (e.g. rhododendron, dog hobble, willows, alders, sycamores, dogwoods, black wahmt and
red maple) must be reestablished within the conshuction limits of the project by tlie end of the growing seaso��
follo�ving completion of consh�ction.
15. The use of rip-rap above the Nonnal High Water Mark shall be minimized. Any rip-rap placed for sheam
stabilization shall be placed in stream channels in such a manner that it does not impede aquatic life passage.
16. Rip-rap shall not be placed in the active tlialweg cham�el or placed in the sheambed in a mamier that precludes aquatic
life passage. Bioengineering boulders or struchires should be properly designed, sized and installed.

17. Heavy equipment shall be operated fiom the banks rather ttian in the streani chanttels in order to minimize
sedimentation and reduce the introduction of other pollutants into the sheam. '
18. All mechanized equipment operated near surface waters must be regiilarly inspected and maintained to prevent
contamination of stream �vaters from fiiels, lubricants, hydraulic fluids, or other toxic materials.
19. The Permittee shall ensure that the final design drawuigs adhere to the permit and to the pem�it drawings submitted
for approval.
20. Discharging liydroseed mixh�res and washuig out hydroseeders and otlier equipment in or adjacent to surface �vaters is
prohibited.
2L If concrete is used during construction, a diy work area shall be maintained to prevent duect contact behvee� curing
concrete and stream water. Water that inadvertently caitacts uncured concrete shall not be discharged to surFace
waters due to the pote��tial for elevated pH and possible aquatic life and fislt kills.
22. No rock, sand or other materials shall be dredged from the stream cl�annel except where authorized by tliis
certification.
23. A copy of this �Vater Quality Certification shall be maintained on the consh�uction site at all times. In addition, the
Water Quality Certification and all subsequent modifications, if any, shafl be maintained with the Division Engineer
and the on-site project manager.
24. All fill slopes located in jurisdictional wetlands sliall be placed at slopes no flatter than 3:1, unless othenvise
authorized by this certification.
25. During the construction of the project, no staging of equipment of any kind is pennitted in waters of the U.S, or
protected riparian buffers.
26. The outside buffer, wetland or water bounda�y located within the construction coiTidor approved by tl�is authorization
shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts to areas tvithin the
fencing are prohibited unless othenvise authorized by this certification.
27. The permittee and its autliorized agents shall conduct its activities in a maru�er consistent with State water qualiry
standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act) and any other
appropriate requirements of State and Federal law. If NCD��Q determines that sueh standards or laws are not being
met (including the failure to sustain a designated or achieved use) or that State of Federal la�v is being violated, or that
further conditions are necessary to assure compliance, NCDWQ may reevaluate and modify this cettification.
28. The issuance of this certification does not exempt the Permittee form complying tvith any and all statutes, rules,
regufations or ordinances that may be imposed by other government agencies (i.e. local, state, and federal) having
jurisdiction, including but not limited to app]icaUle buffer rules, stormwater management rules, soil erosion and
sedimentation control requirements, etc.
29. Tlie Permittee shall report any violations of fliis certification to the Division of Water Quality within 24-hours of
discovery.
30. Upon completion of the project (induding any impacts at associated bonow or waste sites), the NCDOT Division
Engineer shall complete and return the enclosed "Certification of Completion Form" to notify NCDWQ when all
work included in the §401 Certification ltas been completed.
Violations of any condition hereui set forth may result ui revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of tlie
Federa1404 and/or Coastal Area Management Act Permit. This Certific9tion shall expire upon the expiration of the 404
or CAMA permit.
