DANIEL SMITH Director Greenwood Livestock LLC PO Box 2107 Elizabethtown, NC 28337-0535 Subject: Notice of Deficiency Greenwood Nursery AWS820695 Sampson County NOD-2021-PC-0508 Dear Greenwood Livestock LLC: NORTH CAROLINA Environmental Quality November 18, 2021 On October 28, 2021, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) inspected the Greenwood Nursery Farm waste disposal system. We wish to think Mr. Curtis Barwick Technical Specialist, who was present and assisted during the inspection. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to North Carolina General Statutes G.S. 143-215 et seq. Section .402, you have been found to be in violation of your permit as follows: Deficiency 1: Failure of permit Section 2, 12 A protective vegetative cover shall be established and maintained on all earthen lagoon/storage pond embankments (outside toe of embankment to maximum operating level/compliance interior), berms, pipe runs, and storm water diversion with the goal of preventing erosion. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the lagoon/storage pond embankments. All trees shall be removed in accordance with good engineering practices. Required Corrective Action for Deficiency 1: Need to repair the areas of erosion around #5 and #6 lagoons and seed with grass to protect the lagoon bank. When this is completed, send a picture to DWR staff. You are required to take any necessary action to address the above violation: The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the following items within 30 days of receipt of this letter. 1. A picture of the lagoon banks after the repairs and submit to DWR staff. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Diane Harrison at (910) 835- 9785 or diane.harrison@ncdenr.gov.
