Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The project site consists of approximately 158.58 acres site located southeast of the intersection of Hodge Road and Interstate 495 (Knightdale Bypass), to the west of Hodge Road and to the east of the Neuse River in Knightdale, North Carolina within Wake County. The project site is bound by residential development and mixed hardwood -pine forests to the north and south, Hodge Road to the east, and the Neuse River to the west. This project was originally permitted in June of 2020. Work has since initiated at the site and Impacts 2A/B and 3A/B (CWI-2.5 and CWI-2.7) have been completed. Mitigation credits were purchased prior to impacts . Due to uncertainty in the project schedule, the remaining impacts may not be complete by March of 2022, when the current permit extension period expires. Therefore, this project is being submitted for re -permitting to enable continued coverage past the set expiration. It is anticipated that work will be completed by March of 2023. Further, due to the recent uncertainty resulting from the 2020 401 WQC rule vacatur, if necessary it is requested that the project be permitted under NWPs 14, 18, and 33. 4b. Explain the purpose of the proposed project: * The purpose of this project is to construct an affordable and family friendly residential subdivision with cohesion and the necessary amenities southwest of the Town of Knightdale. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The proposed residential development will consist of 276 single-family lots, 103 townhomes, and associated amenities including roadway, stormwater control measures (SCMs), and utility improvements (i.e. public water supply and sanitary sewer alignment). The project is located to the west of Hodge Road, south of Panther Rock Blvd and east of the Neuse River. The proposed project requires the following impacts to jurisdictional features: three (3) road crossings, one (1) drainage/road impact, nine (9) drainage impacts and three (3) temporary impacts for a 30-ft wide utility easements associated with gravity sewer line crossings. These impacts require 0.044 acres of permanent wetland impacts, 0.024-acres of temporary wetland impact, 283 linear feet of permanent stream impact, 137 linear feet of temporary stream impact, 34,911 square feet of permanent Zone 1 buffer impacts, and 34,239 square feet of permanent Zone 2 buffer impacts. Additional impacts to waters of the U.S. are not proposed. The proposed project is the final and complete phase of the project with appropriate land use control measures in place for specific areas which require them. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers. This project was originally approved on June 3, 2020 by the USACE and on June 24, 2020 by NC DWR. The plans have not changed from the previous PCN that was submitted on May 6, 2020. As of today, Impacts 2 and 3 have been completed. These include two stream impacts, one wetland impact and four riparian buffer impacts. The remainder of the impacts will ideally be completed by March 2022, but they may be delayed. 5. Jurisdictional Determinations 5a. Comments: The proposed road crossing impacts are required for connecting the southern and western portions of the site. The proposed utility impact is required for the installation of the gravity sewer line. Both road crossings will include the installation of culverts along the adjacent streams to maintain the hydrologic connection between the up gradient and down gradient areas. Impact 7B is associated with the installation of a gravity sewer line and is a temporary impact for construction which will result in no net loss of wetlands. However, wetlands will be permanently converted from forested to herbaceous. The proposed sewer line will be installed through temporary ground disturbance for open cut installation which is anticipated to cause temporary disturbance to the portions of the wetland area located within the 30-ft wide easement. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including the utilization of the wetland delineation to adjust the layout to avoid and minimize impacts during the design phase of the project. The proposed impacts are required in order for the project's goals to be realized. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high , non jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and cleaning only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initialed within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? USFWS IPaC noted 7 species with the potential to occur in the vicinity of the project area. These include the red -cockaded woodpecker, the Neuse River waterdog, the Carolina madtom, the Atlantic pigtoe, the dwarf wedgmussel, the monarch butterfly and Michaux's sumac. There are no critical habitats in our project area according to USFSW IPaC. The red -cockaded woodpecker's habitat includes pine trees 60 years old or older. The project occurs on a site that was clearcut in 2013. This has led to a dense mid -story and understory habitat which is not conducive to RCW foraging habitat. The project should have no effect on the red -cockaded woodpecker. The Neuse river waterdog, Carolina madtom, and Atlantic pigtoe all prefer habitat with excellent water quality, which does not include the streams on this site. Further, the site is not located within critical habitat areas for any of these species. The project therefore is anticipated to have no effect on these species. Dwarf wedgemussel can be found in the Swift Creek sub -basin, which does not include our project area. The proposed project therefore is anticipated to have no effect on the dwarf wedgemussel. The monarch butterfly prefers areas with milkweed as habitat. Due to the clearcut in 2013, the understory and mid -story are too dense to support this habitat. The proposed project should have no effect on the monarch butterfly. Michaux's sumac prefers open, disturbed areas as habitat. Due to the clearcut in 2013, the understory and mid -story are too dense to support Michaux's sumac. The proposed project should have no effect on Michaux's sumac. According to NCNHP, there is NHP Natural Area within the project area along the Neuse River. Dwarf Wedgemussel was observed in the project area in 1951 and Neuse river waterdog was observed in 1987. There have been no recent sightings of either species, according to NCNHP. Further, it should be noted that the project review area overlaps with a portion of the Neuse River, which will not be impacted. 6. Essential Fish Habitat (Corps Requirement) 6a. The map showed 26 surveyed sites within 1 mile of the project Site. There was one surveyed resource formerly on -site (River Plantation, WA3681) which is no longer extant. If yes, explain how project meets FEMA requirements: Part of the western portion of the site is located within the regulatory 100-year floodplain, portions of Zone AE with a base flood elevation of 174-ft above mean sea level. Impacts to the floodplain were minimized to the maximum extent practicable. Proposed impacts 9, 10A, and 10B fall within this area and are therefore proposed to be permitted under NWP 18. Total impacts associated with 9, 10A, and 10B are: 34-ft (396-sq. ft.) of temporary stream impact for gravity sewer line installation, 2,034 sq. ft. of Zone 1 Buffer Impact & 1,563-sq. ft. of Zone 2 Buffer Impact for gravity sewer line installation, and 1,227-sq. ft. of Zone 1 Buffer Impact & 831-sq. ft. of Zone 2 Buffer Impact for drainage of SCMs which will attenuate flow and control nitrogen. 8c.
