Flat Swamp Bank Parcel Closeout Information
Dear Mr. Kessler:
On November 5, 2013, the Division of Water Resources (DWR) received the Year Five
Monitoring Report, dated November 1, 2013, for the Flat Swamp Mitigation Bank in Craven
County, North Carolina. On November 5, 2013, Katie Merritt, with DWR, along with you and
Scott Frederick with Soil, Water, & Environmental Group, PLLC visited the subject site to
compare vegetation data. In addition, at the request of GreenVest /Flast Swamp, LLC (GVFS),
Ms. Merritt also evaluated the site's condition for closeout of the monitoring requirements. Ms.
Merritt determined that as a whole, the Flat Swamp Mitigation Bank was in great condition and
supports closing out the site for any further monitoring.
At this time, additional information is still needed regarding the long term steward chosen to
provide perpetual protection and maintenance of the subject site. According the conservation
easement provided for this site, GreenTrust Alliance, Inc. (GTA) is the Grantee of the easement
and chosen to be the long term steward. DWR is not familiar with this land steward and has no
information regarding the ability of and qualifications of GTA in providing the long term
protection and maintenance of the Flat Swamp Mitigation Bank as required in the GVFS MBI.
Prior to DWR approval of GTA as the land steward for this Bank, and prior to the final 10%
credit release, DWR will need the following information from GVFS:

• Documentation that GVFS has provided an endowment or sufficient funds to cover the
costs for GTA to implement the long term protection and maintenance of the subject site.
The amount of the endowment does not have to be provided.
• Inventory of projects in North Carolina for which GTA is currently a land steward.
• A Memorandum of Agreement (MOA) signed between GTA and GVFS agreeing to the
terms and conditions of the long term protection and maintenance of the subject site.
Details of the types of maintenance and annual inspections GVFS expects GTA to
provide at the site is required.
• Documentation of GTA's certification under 501 (c) (3) of the Internal Revenue Code
and qualifications outlined in G.S. 105 - 130.24 & G.S. 105- 151.12.
• GTA staff and contact information as well as the staff who will be performing the
protection and maintenance of the subject site.
