Dear Mr. Lloyd:
Effective August 1, 2013, the State Stormwater program was transferred from the (now former) Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to
DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note
that this letter references DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received and
accepted a signed Permit Transfer Application Form for the subject project on May 24, 2017 with additional
information requested on November 8, 2017. In reviewing older projects, it was discovered that a response to the
November 8, 2017 request was never received. The successor -owner of the property has requested to transfer the
permit without consent of the permit holder in accordance with 15A NCAC 02H.1045(1)(c) and G.S. 143-
214.7(c5). A preliminary in-depth review of the documentation submitted with the transfer request determined
that the application is incomplete and that additional information is needed.
Since the transfer was submitted under NCAC 02H.1045(1)(c) and G.S. 143-214.7(c5), please provide the
following documentation in a single, hard coot/ submittal Package to complete the application:
1. On October 27, 2017, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project to determine the status of compliance with this permit,
last issued on April 21, 2009. DEMLR file review and site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. A copy of the completed form entitled
"Compliance Inspection Report" summarizing the findings of the aforementioned inspection is attached to
this letter. Please either address the following items to demonstrate compliance with the permit or submit
a plan of action that provides a timeline in which the following compliance issues will be resolved.
a. Permit Condition III.11: A Permit Renewal Application is to be submitted at least 180 days prior
to the expiration date of the permit. This permit expired on April 28, 2020. To date, a renewal
application has not been received. In addition to the below compliance issues noted during the
October 27, 2017 inspection, a complete Permit Renewal Application must be submitted.
b. Permit Condition II.5 and I1.9: The site has not been constructed per the approved plans. The
following changes were made without submitting and receiving approval for a permit
modification:
i. The creation of a new curb break inlet into the pond that bypasses the forebay.
ii. The pond has been enlarged and the riprap weir that defines the forebay has been
relocated.
iii. The grading of the site has been altered.
c. Permit Condition II.3: The following operation and maintenance issues were noted during the
inspection:
i. Trees are growing on the slopes.
U. There is standing water in the outlet structure, which may be indicative of a blockage in
the drainage piping.
All of the requested information listed above should be received in this Office by October 1, 2021, or the
application will be returned as incomplete. Please note that only two letters requesting additional information

allowed in the ,State Stormwater Program for a total of 30 days to submit the requested additional information. If
the information is not satisfactorily provided after either the second request or 30 days, the project will be
returned. If the project is returned and you wish to re -submit later, you will need to resubmit all required items at
that time, including the application fee.
Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the
project, it is determined that a major modification to the permit is required to resolve the compliance issues, the
transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition, the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.

Inspection Summary:
The Division received a permit transfer application on June 15, 2017. The inspection revealed the following deficiencies:
1. The creation of a new curb break inlet into the pond that bypasses the forebay.
2. The pond has been enlarged and the riprap weir that defines the forebay has been relocated.
3. The grading of the site has been altered.
4. Trees are growing on the slopes.
5. 1 here Is standing water in the outlet structure, which may be indicative of a blockage in the drainage piping in
Landmark Drive.
Prior to approving the transfer, the Division requires that these deficiencies be resolved:
1. Submit revised grading plans showing the extent of the enlarged pond, the revised grading and the new curb break.
2. Submit revised grading plans that show how the runoff entering the pond via the curb break will be redirected into the
forebay side of the pond.
3. Eliminate or relocate the trees that are growing on the sloped part of the bank to the top of the bank.
4. Investigate the standing water in the outlet structure to see if a blockage exists.

Comment: 1. The pond has been extended and is much larger and much closer to the building and the parkin
spaces along the west side.
2. An additional inlet into the pond has been created at the end of the Parking area along the west side.
The approved plans show that this area was to be graded to flow from north to south and into Catch
Basin #4, but the grading appears to go the other way, and a break in the curb was added at the last
space in the parking area. The runoff is supposed to enter the forebav side of the pond on the south
but the additional curb break allows that runoff to enter the pond on the other side of the forebav berm,
bypassing the forebay.

Comment: 3. There are a few trees growing on the sloped banks of the pond. The slopes were recently reseeded
and mulched, but the trees remain. Trees are OK at the top of the bank recommended to be at least 10
feet from the edge of the pond, but trees on the sloped bank create a myriad of maintenance and
stabilization issues.
4. The outlet structure has standing water in the bottom. The outlet piping from the Pond connects into
the existing piping in Landmark Drive. The standing water may be indicative of a blockage in the street
piping. You may want to contact the City or the DOT to investigate.

I attach the inspection report and a small marked up map that may help you to understand the
problems.
I am'not sure why the original PE certification from James Honeycutt, PE submitted in 2009 did not
list any of the deficiencies and changes that I observed.

Dear Mr. Elmore:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that this letter references DEMLR as the Division responsible for issuance of the
permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law
2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, the permit
which already expired on February 28, 2016, shall now be effective from the date of issuance until
February 28, 2020.
On April 12, 2017, the Division conducted a file review of Lot 31 Landmark Industrial Park located at
411 Landmark Drive, Wilmington. New Hanover County. The project is currently operating under
Stormwater Management Permit Number SW8 951105 renewed and reissued on April 21., 2009.
DEMLR research has revealed that ownership of the property covered by this permit has changed due to
the sale of the property and the dissolution of the corporate entity that holds the permit. Please note that
per General Condition III.10 of the permit, the permittee must notify the Division within 30 days of any
name, ownership or mailing address changes, and, per General Condition Ill. 1, must submit a
Name/Ownership Change form and receive approval from the Division.
County tax records indicate that Seahawk Landing, LLC now owns this property. In addition, Elmore
Enterprises, LLC was dissolved by the NCSOS effective December 17, 2015. Please note that Session
Law 2013-121 allows for the transfer of the permit from the original permittee who has been legally
divested of the property via death, dissolution, bankruptcy or foreclosure proceedings, to a new owner,
developer, HOA or POA. It is your responsibility to complete, sign and submit the attached
name/ownership transfer form to this Office before June 13, 2017, along with the required documentation
listed on the form.
Please note that any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement procedures as set forth in NCGS

The successor -owner of the property, Seahawk Landing, LLC is currently in violation of NCGS 143
Article 21 because they do not hold a permit to operate the permitted wet detention pond or to discharge
runoff to surface waters of the State. Seahawk Landing, LLC must either sign off on Mr. Elmore's permit
transfer document, or request that the existing permit be transferred to them under the terms of Session
Law 2013-121, or apply for a new permit. Due to intervening rules changes, a new permit may not be as
favorable as the existing permit.
