DANIEL SMITH Director Mr. Daniel Marring Executive Director Tuckaseigee Water and Sewer Authority 1246 West Main Street Sylva, NC 28779 Dear Mr. Marring: NORTH CAROLINA Environmental Quality November 15, 2021 The Division of Water Resources and Division of Water Infrastructure have conducted joint reviews on the variance request dated June 30, 2021, and the additional information dated October 26, 2021 from Kyle Seaman, PE with McGill Associates, P.A., on behalf of Tuckaseigee Water and Sewer Authority (TWSA). The variance request to 15A NCAC 02T .0506 (b) is for two proposed sequencing batch reactors (SBRs) at the TWSA WWTP No.2 (NC0020214) in Jackson County, NC. Specifically, the SBRs would be located within the 50 feet setback to Scott's Creek (stream index 2- 79-39). The variance request indicates that due to site constraints and the need to keep the existing plant operational during construction, the proposed SBRs are less than minimum setback requirement set forth in 15A NCAC 02T .0506 (b). To provide additional spill protection, a 12-inch ductile iron overflow pipe would be installed for each SBR. The 12-inch overflow pipes are capable of directing a flow greater than the capacity of the influent pumps back to the influent pump station wet well, which would prevent direct discharge to Scott's Creek in the event of overflow from the SBRs. Based on this information, the Division of Water Resources would agree to issue a variance to 15A NCAC 02T.0506 (b) allowing a portion of the SBRs to be located within 50 feet setback of Scott's Creek. The closest point of the proposed SBRs to the nearest bank of Scott's Creek is 23.9 feet. If you have any questions, or require any additional information, please contact me at 919-707-3600.
