Pedersen Cc: Smith, Mike M; Georgoulias, Bethany; Victoria Hoyland; adeyton@ashevillenc.gov; Ledford, Chad; Bergeron, Shannon Subject: Buncombe County Transfer Station and Fleet Maintenance Facility - Hominy Creek Rd Importance: High Buncombe County Staff and DEMLR staff, The Buncombe County Transfer Station and Fleet Maintenance Facility located at 190-194 Hominy Creek Road is required to be covered under a NPDES Permit and to properly monitor and report discharges to surface waters. This Facility has had two incidents in just over a years' time that resulted in releases from its point source discharge outfalls that carried potentially highly polluted water to a heavily recreated area of Hominy Creek. The incidents are as follows: 11/3/2021: Release of diesel fuel from the maintenance fueling area. (Spill - Fleet Maintenance) 8/26/2020: Release of leachate from the transfer station area. (Bypass to MSD sewerline - Transfer Station) Both of these incidents came into the Asheville Regional Office Water Quality Regional Operations Section (ARO-WQROS) as complaints from Citizens the following day of the actual incidents. No notification from Buncombe County staff was received by ARO-WQROS within 24 hours of the incident taking place, nor to our knowledge were any other appropriate Agencies (DEQ, City, County, MSD etc.) properly notified by Buncombe County staff. Upon receipt of the complaints, ARO-WQROS staff contacted Buncombe County Solid Waste staff the following day of the releases and the staff verified the releases had indeed occurred. This Facility has been verbally informed now twice that a Permit is to be obtained and that proper reporting is required. To date ARO-WQROS staff is not aware of a NPDES Certificate of Coverage being issued for this Facility. Proper monitoring and reporting is to take place at this facility. Even though this is a County facility conducting two different activities onsite it needs to be determines if NPDES Permit coverage for any runoff from this facility is required. Please schedule an inspection of this facility to determine if it is operating without a permit and if so what permit is needed for proper coverage to best protect the receiving streams.
