PROJECT SUMMARY: The applicant proposes to remove the existing docking facility and replace it with a new pier, platform, floating dock, and 2 boatlifts for a total of 4 slips. 14 Sandy Point, Perry, Brandon Page Two 9. PROJECT DESCRIPTION The project site is located at 14 Sandy Point on Figure Eight Island, adjacent to Figure Eight Canal and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.5 miles. Turn right onto Sandy Point, travel approximately 0.2 miles to the destination on the right. The property is located on a man-made finger of upland adjacent to the man-made Figure Eight Island Canal adjacent to Banks Channel and Middle Sound on the southern end of Figure Eight Island. The parcel has an existing single family residence and according to the applicant, is approximately 0.36 acres in size and 12' above normal high water (NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. A timber bulkhead approximately 120' in length is located landward of coastal wetlands and NHW. High coastal marsh descends into low marsh, consisting primarily of salt -marsh cordgrass (Sparfina alternaflora), glasswort (Salicornia sp.), and sea lavender (Limonium sp.) ranging in width from 20' to 30' wide directly in front of the bulkhead. Normal high water (NHW) is approximately 14' -18' waterward of the bulkhead. The shoreline as measured by the applicant at the NHW line is approximately 135' in length. The existing docking facility includes a fixed pier that extends east from the bulkhead approximately 41' into the man-made canal, the access pier terminates in a 5' by 24' fixed finger pier that extends north parallel with the shoreline. Two access ramps extend into the canal from each end of the 6' by 25' finger pier onto floating docks positioned perpendicular to the shoreline. The north floating dock measures 6' by 20' and the south floating dock measures 8' by 20'. Between the floating docks is a 13' by 18' boatlift and another boatlift measuring approximately 13' by 13' is located on the outside of the southern floating dock. The existing facility was authorized by State Permit No. 49-09, issued to Ed Turlington on April 18, 2009 and expired on December 31, 2012. State Permit No. 49-09 specifically authorized the addition of the 5' by 24' fixed finger pier and the northern 6' by 20' floating dock. The two boatlifts were authorized on either side of the 8' by 20' single floating dock through General Permit No. 50348 issued on June 14, 2008 (prior to State Permit 49-09) and no permit history could be found for the original pier and floating dock. The private facility currently accommodates up to three (3) vessels. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of this canal, Banks Channel, and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to remove the existing docking facility and replace it with a new pier, platform, floating dock, and 2 boatlifts for a total of 4 slips. The existing docking facility and boatlifts would be removed and a new access pier measuring approximately 6' wide by 48' in length would extend from the bulkhead into the canal terminating in a 16' by 12' T-Head platform. An access ramp from the platform would extend onto a floating dock measuring approximately 50' by 8', positioned parallel to the shoreline at the pier headline. The applicant proposes to install two boatlifts located on each end of the floating dock. The boat lifts would measure approximately 12.5' by 12.5' and 125 by 14' (see Sheet 3 of 4). The proposed new docking facility configuration would extend no further than the existing pier headline, which is slightly over the %-width at approximately 54' into the 185' wide waterbody. The applicant indicates that the water depths in the vicinity of the floating dock are between 14 Sandy Point, Perry, Brandon Page Three approximately -3.5' and -5' at normal low water (NLW), which is consistent with DCM confirmed depths around the surrounding docking facilities. The proposed configuration would not encroach into either neighboring 15' riparian corridor setback area. 10, ANTICIPATED IMPACTS As proposed, the new docking facility would result in incorporation of 1,121 ft2 of Public Trust Area and Estuarine Waters and 132 ft2 of Coastal Wetland shading, The proposed development would not encroach into either of the adjacent 15' riparian setbacks, nor will it exceed the pier headline. Project Narrative 3.1.1 Project Location and Existing Conditions The project is adjacent to Masons Channel at 14 Sandy Point on Figure 8 Island, New Hanover County. There is a single-family residence currently located on the property. There is an existing wooden bulkhead constructed under an unknown permit number. There is also an existing fixed pier and floating dock constructed under CAMA Major Permit 49-09, issued April 18, 2009. Two boatlifts were added through CAMA General Permit 50348D at an unknown later date. Water depths were provided by the client, taken on October 15, 2021 relative to Normal Low Water. Structures and were located by Patrick C. Bristow Land Surveying on May 15, 2020. Normal High Water was delineated by Land Management Group and was approved by DCM staff on October 15, 2021. See Appendix B for details. Waters in the project area are classified as SA ORW and are open to shellfishing. The area is not a primary nursery area. 3.1.2 Proposed action The applicant proposes removal of the existing docking facility. The applicant proposes construction of a fixed pier and platform with access ramp to a floating dock and two boatlifts. The proposed fixed pier will measure 6' wide x —53' long leading to a 12' long x 16' wide platform. The fixed pier would shade approximately 109 square feet of coastal wetlands and be constructed a minimum of 3' above existing grade. An access ramp will lead to an 8' wide x 50' long floating dock. Two boatlifts are proposed, one on the northern and one on the southern side of the floating dock. The northern boatlift will have a capacity of 10,000 Ibs and measure 12.5' long x 12.5' wide. The southern boatlift will have a capacity of 16,000 Ibs and measure 12.5' long x 14' wide. Length of shoreline at Normal High Water is 135' and was approved by DCM staff on October 15, 2021. There is no upland work proposed on the property. See Appendix A for details. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. NOTE: Failure to comply with the survey requirements of Condition No. 7 of this permit shall result in a violation of this permit. 8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alterations, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or Ihs authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States or the State of North Carolina.
