Specifically our conversation centered around Condition 9 of the water quality certification. Condition 9 requires that Duke Energy to monitor downstream of the stream channels impacted by the project, to make sure they continue to provide aquatic life propagation and biological integrity equal to pre- impact conditions. Phase 2 of the project has been completed and impacted streams SC8, SC9 and SC10. Duke Energy submitted the Certificate of Completion for the Phase 2 of the project in February 2013. Duke Energy has conducted visual monitoring on the stream channels as required by the certification, with the background monitoring completed in November 2012. However, because the second phase of the project was not complete until February 2013 we were unable to complete a full monitoring period meeting permit conditions by June 1 2013; the date for submittal of the annual report in the certification. By this email Duke Energy is requesting that our first annual report be submitted to your office by June 12014. This will allow Duke Energy to complete a full year of post impact stream monitoring in compliance with permit conditions. All data collected by Duke Energy to date will be submitted by June 1, 2014. Please reply to this email with the Divisions approval or disapproval of this proposal for the annual report submission.
