Dear Mr. Nelson:
On October 28, 2013,the Division of Water Resources(Division) received your application requesting a 401
Water Quality Certification and Buffer Authorization for your project. The Division has determined that your
application is incomplete and cannot be processed.The application is on-hold until all of the following
information isreceived:
1. Please indicate the specific location and amount of buffer impacts to zone 1 and zone 2 of any
proposed access corridor or temporary'road to conduct the dock construction, stabilization and spoil
removal. Please note that temporary access roads are allowable within the buffer but must include
restoration of the vegetation within 6 months of disturbance according to Title 15ANCA[028
.O243(G).
2. The plans list"Potential Future Access Trai|". The proposed boat dock will require access for the future
residents. Please list these impacts and specify if this access will be a road for vehicles or a walking
trail and include any parking area or other structures ifapplicable. Please describe the proposed
surface of the access road or trail and list the specific buffer impact amounts to zone 1 and zone 2
including any vegetation removal.
3. The 6'x 15' stationary pier appears to also be in the buffer. Please list the material of construction for
this structure and list the specific buffer impact amounts to zone 1 and zone% including any vegetation
removal.

Pursuant to Title 15A NCAC 02H .0502(e),the applicant shall furnish all of the above requested information for
the proper consideration of the application. If all of the requested information is not received in writing within
30 calendar days of receipt of this letter,the Division will be unable to approve the application and it will be
returned. The return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three(3)copies of all of
the above requested information to the 401 & Buffer Permitting Unit, 1650 Mail Service Center, Raleigh, NC
27699-1650.
Please be aware that you have no authorization under the Water Quality Certification Rules for this activity
and any work done within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
