He said that the species could occur in along any ditch/canal with brackish water. So, I do believe a survey would be in order. This is the best time of the year to do one. There is a population nearby at Mattamuskeet NWR that a surveyor could look at to familiarize themself with the species. I will need to coordinate with the surveyor because there are a couple of very similar species that could be confused with sensitive joint-vetch. Hydeland Canal would not be affected by a semidiurnal tide cycle. The area is only affected by wind tides in this part of the Pamlico Sound. With that said the water in the adjacent canal is brackish and does support coastal marsh species. CAMA did not identify the shoreline to be stabilized as coastal marsh. When I reviewed the site the shoreline that’s left is dominated predominantly panicum grasses. The heavy wave activity created by heavy boat traffic has eroded the shoreline into the road shoulder and road. Let me know if you would require a survey for sensitive joint- vetch or want to meet onsite. There is coastal marsh on the opposite side of the road outside of the project area. If you are concerned that the adjacent stabilization activity would disturb the eastern black rail I will include the moratorium for the nesting season. If this canal is tidally influenced, then it may be habitat for the federally threatened sensitive joint- vetch. Sensitive joint-vetch is generally found in intertidal zones where the plants would be flooded 2 twice daily, often along ditches. Has a survey been done for the species? The survey season is July - October. 2. Although the eroding bank is not suitable habitat, the adjacent marsh may be suitable habitat for the federally threatened eastern black rail. If suitable habitat is present, there could be temporary disturbance of eastern black rails. If suitable habitat is present, then the rip rap should be placed outside the nesting season (April 15 - June 30). For Section 7, I would be able to concur with a "May Affect, Not Likely to Adversely Affect" conclusion if the nesting season is avoided.
