Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S &EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that the project engineer could design a site plan that would minimize impacts to the maximum extent practicable. The proposed project includes one impact area. The proposed impact includes 140 linear feet of permanent stream impacts to an intermittent stream and associated riparian buffers. This road extension is being required by the City of Raleigh. This extension would complete the connection of the Pine Knoll Drive which is a collector road on the City's transportation plan. In addition, this extension would provide access to the property and provide two points of ingress and egress in the event of an emergency. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 39. With respect to commercial development conditions (NWP 39- Regional Conditions section 4.0) the applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no impacts associated with single - family recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream classification for this project is C, NSW (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters). 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Per the project engineer: Provide 2:1 side slopes on the road embankments for Pine Knoll Drive to minimize impact to channel and buffer. Recess the 48" culvert to 8" below existing channel bottom elevation at both inverts to promote conveyance of small aquatic life. All proposed on -site impervious, as well as a portion of off -site impervious from the proposed Pine Knoll Drive, will be treated through a 90% TSS reduction wetpond, which also detains stormwater and reduces nutrients. 2. A 20,530 SF church is proposed with associated parking, sidewalks and drive, totaling 100, 357 SF of proposed impervious area. The project also includes the connection of a 41' b -b street section of Pine Knoll Drive, including the addition of a 5 R wide concrete sidewalk. Initially, a portion of the site currently drains from to an existing pond in the northwest corner of the property, and the rest of the site drains to the southwest corner of the property. A wetpond is proposed to both detain the 2 and 107yr, 24 -hr design storms as well as reduce the nitrogen export from the site. The wetpond also provides 90% TSS removal from the runoff associated with the project. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Powerhouse Church of Jesus Christ project will be a small scale development. Additionally, the project is located within the City of Raleigh's jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post - construction stormwater management requirements, and 2) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved. We anticipate that the DWQ will advise us if any additional information is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. This property will be connected to the City of Raleigh's Sewer System. The City will ensure that capacity of their treatment facility will not be exceeded. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self - monitoring, record keeping and reporting requirements are required. Sediment and Erosion Control Measures Sediment and erosion control measures shall not be placed in wetlands or waters without prior written approval by DWQ. All devices shall be removed and the natural grade restored within two (2) months of the date that the Division of Land Resources has released the project. Stormwater Management Plan and Diffuse Flow Provisions One (1) copy of the City of Raleigh approved Stormwater Management Plan (Febraary 14, 2008) for this project must be submitted to this office before any impacts authorized by this certification may occur. All stormwater shall be directed as diffuse flow at non - erosive velocities through the protected stream buffers and will not re- concgntmte before discharging into the stream as identified within 15A NCAC 2B.0233(5) If diffuse flow as per 15A NCAC 02B .0233(5) has not been achieved, then the DWQ shall be notified and corrective actions to restore diffuse flow shall be taken if necessary to impede the formation of erosion gullies. At no time shall stormwater from the proposed development be piped directly through the buffer without prior written authorization by DWQ. The structural stormwater practices as approved by the City of Raleigh, as well as drainage patterns, must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances, and on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by fixture property owners. 7. Work in the Dry All work in or adjacent to stream waters shall be conducted in a dry work area. Approved best management practices from the most current version of the NC Sediment and Erosion Control Manual, or the NCDOT Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams, and other diversion structures shall be used to minimize excavation in flowing water. 8. If concrete is used during the construction, then a dry work area should be maintained to prevent direct contact prevent direct contact between curing concrete and stream water. Water that inadvertently contacts uncured concrete should not be discharged to surface waters due to the potential for elevated pH and possible aquatic life/fish kills. 9. Culvert Installation Culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re- established or, if the pipes installed in a perched manner, the pipes shall be removed and re- installed correctly. Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the stream up or down stream of the culvert(s). Installation of culverts in wetlands must ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. Existing stream dimensions (including the cross section dimensions, pattern and longitudinal profile) shall be maintained above and below locations of each culvert. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the str+eambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of Habitat for Humanity of Wake County EXP 08 -0213 Page 4 of 5 February 20, 2008 the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. The applicant is required to provide evidence that the equilibrium shall be maintained- if requested in writing by DWQ. The establishment of native, woody vegetation and other soft stream bank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If ripmp is necessary, it shall not be placed in the streambed, unless specifically approved by the Division of Water Quality. 10. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699 -1650. 11. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 2B.0233 and GC 3705. 12. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and riparian buffers in order to assure compliance for future wetland, water and riparian buffer impact. These mechanisms shall be put in place prior to impacting any wetlands and/or waters approved for impact under this Certification Approval. 13. Notification of Construction The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within ten (10) days of the commencement of construction. The applicant/permittee and their authorized agents shall conduct all activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal Law.
