Dear Mr. Barber:
Please reference the Department of the Army (DA) permit (SAW-2018-00240)
issued to you for discharges of dredged or fill material into waters of the US associated
with construction of the Publix Greensboro Distribution Center and associated
infrastructure, on your property located off US Highway 70 near its intersection with
Birch Creek Road, adjacent to unnamed tributaries to Little Alamance Creek, near
Greensboro, in Guilford County, North Carolina. These activities involved the
permanent discharge of fill material into 4,780 linear feet of intermittent and perennial
stream channel, 1.01 acres of riparian non-riverine wetlands, and 1.65 acres of open
water impoundments, the temporary discharge of fill material into 90 linear feet of
stream channel, and indirect impacts to 0.20 acre of wetlands and 252 linear feet of
stream channel. Compensatory mitigation was implemented for the unavoidable
impacts by securing stream and wetland credits from private mitigation banks and the
North Carolina Division of Mitigation Services.
Also reference your permit modification request letter, dated October 19, 2021
(received October 20, 2021), proposing authorization for the permanent discharge of fill
material (not resulting in a loss of waters) into a total of 10 linear feet (<0.01 acre) of
stream channel. You state that these additional impacts are necessary to install a 12-
inch sewer line crossing (western sewer outfall, Impact S11) via open cut trenching and
place a layer of rip rap in the stream, level with the existing stream channel bottom.

You also note that this sewer crossing was originally designed to avoid impacts via
jack and bore trenchless installation, but multiple attempts have resulted in the bore
being redirected off course due to hitting premature weathered rock.
The Corps has completed the evaluation of your request and determined that it is
appropriate and reasonable, and no public notice is required for this modification.
Therefore, the permit is modified per your request. This work must be constructed per
"Publix Greensboro Distribution Center" Sheet Nos. C-509, C-528, and C-542, and
"Preliminary Jurisdictional Waters of the U.S. Impacts Map" Sheet 4 of 12, included in
your permit modification request letter.
All other conditions of the permit, including the permit expiration date of December
31, 2030, remain in effect as written. If you have any questions, please contact Mr.
