Dear Mr. Wise:
On April 25, 2017, the Department of the Army issued a permit to Duke Energy for
the Cedar Cliff Auxiliary Spillway Upgrades Project in Tuckasegee, Jackson County,
North Carolina. The Corps issued modifications to this permit on June 21, 2019, and
October 29, 2020. A written request for a third permit modification was received on
October 5, 2021.
This request involves authorization for additional impacts associated with
modifications in the design for the haul/access road and to extend the expiration date of
the permit. The permit is modified to include additional impacts associated with the
modification to the haul/access road, as shown on enclosed plans. These impacts
consist of 0.36 acres of permanent impacts to open waters. The total authorized open
water impacts for this action are now 52.42 acres of temporary open water impacts and
10.927 acres of permanent open water impacts. Also, the submittal requested the
expiration date be extended to December 31, 2025 in order to complete the permitted
work. The permit expiration date is hereby extended to December 31, 2025.
The permit is hereby modified to include the work as noted above. All conditions of
the original permit remain applicable.
