The Town's NPDES Permit was reissued June 30, 1994, with an effective date of August 1, 1994. The reissued NPDES Permit contains a quarterly chronic toxicity limitation of 9.0% which becomes effective upon expansion above .25 MGD and lasting until permit expiration. Prior to expansion the facility's IWC is 5.5%. This office previously provided comments to the Winston- Salem Regional Office regarding toxicity condition language found in Attachment B of the Order. Several corrections noted below have been made to Attachment B. 1. Testing months have been altered from a quarterly schedule of January, April, July, and October to a quarterly schedule of March, June, September, and December to coincide with testing months specified by the reissued NPDES Permit. 2. Language specifying when the first test is due has been deleted. New language has been included which states, "Toxicity monitoring shall be conducted during the months of March, June, September, and December." 3. A revision to the paragraph addressing potential impacts to the receiving stream has been revised to read, "Should any test data..., then the NPDES Permit may be reopened..." We would recommend the revised Attachment B be transmitted to the Town with instructions to discard the previous Attachment B and to insert the new page. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration defined as treatment two in the North Carolina procedure document is 6.0%. The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the Order conditions. Toxicity monitoring shall be conducted during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted fmal effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Raleigh, N.C. 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a test failure, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, then the NPDES permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will constitute noncompliance with monitoring requirements.
