Box 99 Sparta, North Carolina 28675 Subject: Final Approval of Pretreatment Program Town of Sparta NPDES Permit Number NC0026913 Alleghany County Dear Mr. Douglas: The Town of Sparta has successfully completed the required activities cited in the Town of Sparta's Wastewater Treatment Plant NPDES permit Part III. (B). for the development of a Division of Environmental Management approved pretreatment program. With consideration of the successful completion of the required activities and the public comments received on the delegation request, the Pretreatment Program for the Town of Sparta is approved as of March 6, 1996. The Town of Sparta's Wastewater Treatment Plant NPDES permit will be the Division of Environmental Management's primary instrument for Pretreatment Program enforcement. This permit was issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the US Environmental Protection Agency. The Division of Environmental Management will retain the authority to require changes in your local pretreatment program, as appropriate. If any part of the approval is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and be filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this approval shall be final and binding. This program approval does not affect the legal requirements to obtain other permits which may be required by the Division or any other Federal, State or Local Agency. P.O. As such, per Part III, B, 10, of the NPDES permit, the Town shall attend periodic meetings with the Division to review enforcement of pretreatment requirements and other pretreatment issues. The compliance status for each industrial user must be judged for each six-month period (January 1-June 30 and July 1-December 31), and appropriate enforcement actions initiated in accordance with the Enforcement Response Plan submitted to the Division. We look forward to working with the Town of Sparta in its role as a local control authority of the pretreatment program.
