Reference: Notice of Violation
Dear Mr. Boss,

After review of your letter dated September 30, 2021, North Carolina Division of Water
Resources inspection conducted on September 21, 2021 the following action have been taken
to correct deficiencies noted during the inspection:
Description of Violation:
Spill Response Plan has was completed on 10/2/2021 and is attached for your
review. This is a self -generated plan from the Maintenance Director of the Waste-
water Plant.
2. Grease Control Ordinance has been established and will be taken the town council in
November for their approval. The Grease Control Plan will become part of Chapter
5, Municipally Owned Utilities, Section 13. Copy is attached for your review.
3. A Collection Systems Maintenance and Inspection Log have been established. This
will contain annual and bi-annual inspection. Inspections will be maintained in Town
Hall and at the Waste -water Plant office
4. High Priority Waste -water lines Inspection Log has been generated to insure
inspections are performed twice a year. Attached are copies of the logs prepared by
Maintenance Superintendent.
Remedial action has been taken to correct these deficient areas in the Waste -water
Department within the Town of Bakersville. Also educational materials have been
obtained and copies will be provided to all customers bi-annually and included on our
town web -site.

Spill Response Plan
The following personnel are to be notified in case of a waste water spill within the
waste water collection system.

In the event of a spill, the Mayor and Maintenance Director will conduct an
immediate assessment of the sewage spill. The contractor will be contacted to
respond with his front end loader/backhoe if the size of the spill is larger than
what the town maintenance personnel can contain. The contractor upon his
arrival will build an earthen dam to contain spill. Once the spill has been
contained waste water will be either pumped or hauled to the WWTP.

•Septic/Transport Truck (Mayland Septic)
Proposed Ordinance (Action to be taken November 29, 2021)
Grease, Fats, Oils, etc.
I. Grease, oil, and sand interceptors shall be provided when, in the
opinion of the Collection Systems ORC, they are necessary for
the proper handling of wastewater containing excessive amounts
of grease and oil, or sand; except that such interceptors shall not
be required for residential users. All interception units shall be
of type and capacity approved by the Collection Systems ORC
and shall be so located to be easily accessible for cleaning and
inspection. Such interceptors shall be inspected, cleaned, and
repaired regularly, as needed, by the user at their expense.
II. For the Town of Bakersville's Collection System, the Grease
Control Program shall include bi-annual distribution of
educational materials for both commercial and residential users
and the legal means to require grease interceptors for new
construction and retrofit and if necessary, of grease interceptors
at existing establishments.
