HomeMy WebLinkAbout20211495 Ver 1_Recommendations Meyers 8733 Bald Eagle FINAL_20211102RECOMMENDATIONS FOR 8733 Bald Eagle Lane, Chris and Michelle Meyers 10/13/2021 Shoreline length =106' x 8' = 848 ft2 (maximum allowable) Proposed pier = 6' x 99' = 594 ft2 (credit) Proposed gazebo = 20' x 20' = 400 ft2 Proposed floating dock = 8' x 42' = 336 ft2 Proposed floating dock = 8' x 14' =112 ft2 Proposed boatlifts (2) = 14' x 14' = 392 ft2 (not counted) TOTAL = 848 ft2 Due to the marginal water depths and potential impacts to active shellfish beds it is this office's recommendation to require stops at 18" above the substrate for the proposed floating dock and boatlifts. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to Primary Nursery Area, shallow bottom, and shellfish beds. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design, and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. It appears that the project is CONSISTENT with the use standards set forth in NCAC 15A 07H .0208(b)(6), including the eight -square foot rule,'/4 width rule, and the pier width rule. This office has no objection to the proposed work, provided it is consistent with all other local, state, and federal permitting requirements. Any permit issued should include standard conditions for private docking facilities. The proposed bulkhead with associated Coastal Wetland fill appears to be INCONSISTENT with NCAC 07H .0208(b)(7)(B) due to the inability to locate an existing bulkhead onsite. It is this office's recommendation that any permitted bulkhead shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources.
