You know, Bob Z gets on my nerves asking for this favor & that favor! I guess what he is asking here is for you to do a
"re- issue" letter for DWR 13 -0684 from July. And you are correct — he gets too wrapped up in the email loop.
When he "advance" emails us an application that will be hand delivered — I totally ignore it — because until I get that
paper copy & $$ - it means nothing to me.
So, do you need Bev to scan in this emailed version of his modification request? It'll have to wait on Bev anyway + our
office copier, printer, scanner is kaput & Toshiba hasn't called me back yet.

The PDF provided in my email on Thursday, included a copy of the Corps approval, and a revised
application package that they requested us to provide to include the revised PCN, impact tables,

Hi Bob,
My understanding is that in this case, where impacts are reduced, it would not require an additional application
fee. Also, you do not need to re- submit the entire permit package. For the sake of consistency, please just submit two
copies of the following information:
1) Explanation of reduced impacts (information in your email).
2) A location map that depicts reduced impacts.
3) The stream impact page from the PCN application showing the reduced impacts.
This way we will have the updated information for the file. Both copies would go to the Central Office and then I'll get a
copy and will revise the DWR approval letter. I hope this process seems reasonable enough.

Cherri, Karen & Laurie:
Attached is a modification request to DWR 13 -0684 approved on July 15, 2013. The USACE
withdrew the applicant's July 3, 2013 application including the two (2) proposed stream crossings,
stating that there was not an immediate need for the 2nd crossing. A meeting was held with the
applicant's agents, USACE and City of Raleigh. The City agreed not to require the applicant to
construct the road across the western most stream crossing. As a result, the applicant's agents have
removed the road crossing from the plans and are now only requesting one (1) road crossing of a
stream in this application. Mitigation will not be required given the reduced impacts. The USACE
approved the revised request on March 18, 2013 (see attached). The applicant requests that DWR
revise their July 15th approval letter. I'm hoping that you can do this (given the reduction in impacts)
without an additional application fee, but let me know if that's not the case and if you require the
fee. Also, I'm hoping that we can avoid having to kill a small tree and send in the necessary paper
copies, but let me know if you need those too.

On behalf of the Owner, Center 205, LLC (Attn: Mr. Roy E. Carroll, II - Manager) please find attached a complete
application and supplemental information requesting written concurrence from the US Army Corps of Engineers
( USACE) and the N.C. Division of Water Resources (DWR) that the activities proposed below may proceed under
Nationwide Permit (NWP) 29 & 18 and General Water Quality Certification (GC) 3890. The applicant is also
requesting a Neuse River Riparian Buffer Authorization Certificate and non -404 General Permit approval with this

conditions and your submitted application and attached information dated 10/17/2013. Any violation of the attached

appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are
under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the
activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You

3i. Comments: Permanent impacts to streams have been avoided to the maximum extent practical. There is one (1) road
crossing permanently impacting 148 LF of perennial stream; of which the USACE considers 33 LF of stream impact as
temporary due to the fact that the rip rap dissipator will be buried. The applicant understands that the NCDWQ does not
make this distinction when calculating stream impact and will therefore consider the 148 LF of stream impacted by culvert and
rip rap to be permanently impacted. The other 20 LF of stream impact is temporary for the installation of a sanitary sewer line.
