Do not click links or open attachments unless you verify. Send all suspicious email as an attachment to Report Spam. Lyle and Stephanie, at long last I have the revised impact maps for this project. As requested a geotechnical report was conducted (copy attached) and the arch span design was revised based on that (see plans and footing correspondence.pdf). I have attached a updated PCN form, a cover letter to this email. The geotech report and footing correspondence in in a second email due to size. Let me know if you have questions or need anything else. am attaching a photo at the span location as a reminder of what an unstable "grand canyon" we are dealing with, there is a 4' tall soil auger in the photo for scale. We did NCSAM on both Streams let me know if you want copies, since mitigation thresholds are no reached I assumed you do not need them. They both came out as "MEDIUM" quality. Stream 1 was full of sandy sediment and appeared to still be aggrading. I didn't find anything in it beyond amphipods. I think it's intermittent, but I originally put perennial on the PCN application and JD so I left it that way in this revision. I didn't run a DWR stream form on it, but suspect I'd come up in the high 20's somewhere. So, it could be barely perennial. Stream 2 (at the span location) while very deeply incised in essentially a deep gully/trench, and very unstable banks in places, had very clean, clear water, good substrate & habitat, fish, salamanders, crayfish, etc. (see attached photo set w/ close up of stream and critters). It's definitely perennial. Kevin C. As a reminder Originally 24' (22'± between footers) — span was proposed Currently 38' (30'± between footers) — detail attached is proposed. Even with the much wider span they were still so close to the channel bank on the east side and at a small area at the north that after talking to Lyle I suggested they propose small channel impacts at those locations (see page 7) impact amounts are listed on Page 1 and will still be below 0.02 acres of stream, it seems to me that from a linear foot standpoint that stream impact would be temporary since the stream channel will remain open (not piped) but will just be realigned. The applicant is requesting approval to utilize Nationwide permit 29 from the USACE and associated the 401 Water Quality Certifications as well as a Buffer Authorization from N.C. Division of Water Resources (NCDWR). Impacts are below wetland and stream loss mitigation thresholds but Impact 2 will require buffer mitigation. The proposed project is a residential apartment complex. For more details see the attached site plans, maps and PCN form. The proposed impacts are for fill for two road crossings (NWP29). Impact 1 is a culverted crossing. Impact 2 is an arch span but due to width and height of the incised stream footings cannot be constructed without impacting the stream channel. We have chosen to consider these to be permanent impacts underneath the span, only the temporary construction access at each end of the span is considered temporary. The arch span is required to avoid backwater on the adjacent upstream property. No rip rap is required at the arch span. An aerial sewer line is proposed that has no stream or wetland impacts and is deemed allowable by the buffer rules. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts through project design: * S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Impact 1 is proposed permanent and temporary wetland, stream and riparian buffer impacts for a road crossing. This road crossing is necessary for access to the central portion of the property. Stream and riparian buffer impacts at Impact 1 have been minimized by utilizing headwalls and a cofferdam with diversion and pump around. Impact 2 is proposed permanent stream and riparian buffer impacts for a road crossing. The road crossing is necessary to connect the west side of the property to the east side. Arched culvert has been utilized to minimize stream & buffer impacts. Impact 3 is proposed permanent riparian buffer impacts for an aerial sanitary sewer crossing. The aerial crossing was proposed to avoid stream impacts. Note that temporary stream impacts will be brought back to pre -construction stream bed elevations and the stream banks will be stabilized. 1 b. Specifically describe measures taken to avoid or minimize proposed impacts through construction techniques: * The project will require an approved Erosion & Sediment Control Plan, reviewed and approved by the City of Raleigh. Typical measures such as silt fence, riprap outfalls, tree protection fencing, sediment basins will be required for this project. At stream crossing 1, a coffer dam with a pump around will be utilized to dewater the stream before construction activities take place within the stream bed. 2. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules? o Yes ❑ No 1 b. All buffer impacts and high ground impacts require diffuse flow or other form of stormwater treatment. If the project is subject to a state implemented riparian buffer protection program, include a plan that fully documents how diffuse/dispersed flow will be maintained. All Stormwater Control Measures (SCM) must be designed in accordance with the NC Stormwater Design Manual (https://deq.nc.gov/about/divisions/energy-mineral-land-resources/energy-mineral-land-permit- guidance/stormwater-bmp-manual). Associated supplement forms and other documentation must be provided. What Type of SCM are you providing? Will this project (based on past and reasonably anticipated future impacts) result in additional development, which could impact nearby downstream water quality? * ❑ Yes ❑x No 3b. If you answered "no", provide a short narrative description: We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Pointe at Town Center project is a residential development. Additionally, the project is located within the City of Raleigh ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition Best Management Practices may be required that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed. 3c.
