Comments from the WRC on this project are offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d). This work will not harm trout and does not need to be completed outside of the trout spawning moratorium. Since trout will not be affected, we do not recommend any modifications of the proposal or special conditions for the permit. Thank you for the opportunity to review and comment on this project. The Ordinary High Water Mark (OHWM) of the unnamed tributary was indicated by the following physical characteristics: clear natural line impressed on the bank, shelving, and the destruction of terrestrial vegetation. Remarks: This jurisdictional determination is only for the stream proposed for impacts associated with this Nationwide Permit verification and does not include any other waters /wetlands that may be located on the project site.
