PROJECT SUMMARY: The applicant proposes to modify Major Permit #50 -07 to include the construction of additional elevated boardwalk along the shoreline of several commercial properties as well as a public docking facility with six boat slips as part as their sound side boardwalk project. Project Setting Chris Layton, Town Manager for the Town of Duck, has requested the attached application be processed as a major modification of the existing CAMA Major Permit #05 -07. The proposed modification is for a boardwalk extension and the construction of an additional docking facility. The project site is located along the shoreline of six commercial properties adjacent to the Currituck Sound within the Town of Duck, Dare County. The project begins at 1186 Duck Road (NC -12) and continues south along the shoreline to 1174 Duck Road (NC -12). The project site incorporates a total of ±149,000 sf ( ±3.42 acres) and has ±1,147' of shoreline. CAMA Major Permit #50 -07 was issued to the Town of Duck on April 3, 2007 for the construction of a sound side boardwalk with observation platforms, a pier and canoe/kayak launch areas, as well as a playground, amphitheater, gazebo stage, picnic shelter, driveway and parking areas on Town property. This permit was modified and refined as follows: - A Minor Modification was issued on November 13, 2007 to extend the pier and construct wooden decking on the landward end of the pier. - A Major Modification was issued on October 7, 2010 through the CAMA Express Permit Program to extend the boardwalk to the north and south as well as construct two office buildings within the upland area. - A Refinement was issued on January 25, 2011 for minor boardwalk realignments. - A Major Modification was issued on March 18, 2011 for the addition of a 4 -slip public docking facility. - A Refinement was issued on June 27, 2011 for the addition of a cantilevered wooden platform to house solar panels and batteries to power low wattage lighting to be installed on the boardwalk. - A Refinement was issued on November 14, 2011 for three additional cantilevered platforms for solar panels and the installation of five pilings with navigation lights. - A Refinement was issued on May 29, 2012 for an additional cantilevered platform housing solar panels. To date, all work authorized under this permit has been completed. The entire length of shoreline within the proposed project area has been hardened with bulkheading. Five of the properties contain commercial buildings and gravel /paved parking areas located adjacent to the bulkhead that were constructed prior to the implementation of the CAMA 30' Buffer requirements. Highground elevations range from 3.5' to 10' above normal water level (NWL). Three piers of varying lengths are located along the project shoreline. The northernmost pier is located at 1186 Duck Road and has a total length of ±72'. A ±50'x25' area of coastal wetlands Town Of Duck - MAJOR MODIFICATION TO MAJOR PERMIT #50-07 Field Investigation Report Page 3 is located immediately to the south of this pier waterward of the bulkhead. Species observed include Spartina altemiflora and Juncus roemerianus. A ±200' storm damaged pier is located at 1184 Duck Road. This property also includes a smaller ±10'x10' isolated patch of Juncus roemerianus that is growing waterward of a northern facing section of shoreline. The third and southernmost pier is located at 1176 Duck Road and has a total length of ±195'. The project area is bordered on the north by similarly developed properties with natural shorelines as well as the previously authorized portion of the Towns boardwalk project. A private residential property is located adjacent to the project area to the south. This property includes a bulkhead, a pier, a single family dwelling and a pool. The waters of the Currituck Sound are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Water depths within the Currituck Sound at the project location range from -1 to -3 feet below NWL. There is approximately 3.5 to 4 miles of open water to the west of the site. The bottom substrate within the project area is made up of fine sands. The near shore area of the sound has a dense coverage of submerged aquatic vegetation (SAV). Additional State and Federal Agency permits issued for the original CAMA Major Permit #50 -07 issued to the Town of Duck include NCDWQ Stormwater Permit #7060708 issued on March 21, 2007, NCDWQ General Water Quality Certification #3400 (DWQ Project #061215) issued August 4, 2006 and the US Army Corps of Engineers assigned the project COE ORM #SAW - 2006 -40261 -128 on August 2006 and authorized the development under General Permit #198000291. Permits issued in relation to a Major Modification to CAMA Major Permit #50 -07, processed through the Express Permit Review Program, include NCDWQ General Water Quality Certification (GC3641) assigned as DWQ Project #061215 Ver.2 issued September 24, 2010 as well as the US Army Corps of Engineers assigning the project AID SAW- 201001633 and authorized via Tier II PGP #198000291 issued on October 5, 2010. A Major Modification to CAMA Major Permit #50 -07 issued on March 18, 2011, for the addition of a public docking facility, was authorized by the US Army Corps of Engineers under General Permit #SAW- 201001633 Development Proposal The applicant proposes to modify the existing permit to construct ±770' of 10' wide elevated wooden boardwalk to provide pedestrian access along the Sound and construct an additional docking facility to provide daytime dockage. The Town has constructed the previously permitted sections of boardwalk to create a greenway connector for the community and to alleviate heavy pedestrian foot traffic immediately adjacent to NC -12. According to the Town, a recent count of pedestrians on the boardwalk for a one month period during the summer of 2013 revealed that 35,000+ pedestrians used the boardwalk during that timeframe. The boardwalk will begin at the Wings store located at 1186 Duck Road, where the previously permitted section ended, and continue along the shoreline in a southerly direction. The boardwalk will terminate at the Aqua Restaurant located at 1174 Duck Road where access back to NC -12 will be available. The meandering boardwalk will have a height that varies from Town Of Duck -MAJOR MODIFICATION TO MAJOR PERMIT #50-07 Field Investigation Report Page 4 3.5' to 10' above NWL and will traverse land (±2,830 so, open water (±4,820 so, SAV beds (±1,417 so and coastal wetlands (±50 so. The height of the boardwalk was designed to match up with the existing bulkheads and piers and to minimize viewshed impacts to the existing businesses on the properties. The layout of the boardwalk was designed to connect the existing businesses along the route as well as reduce the wetland and SAV impact to the maximum extent possible while preserving the individual properties ability for riparian access, performing bulkhead maintenance or future bulkhead replacement. The proposed docking facility will extend from the boardwalk just south of the Duck Soundside Shoppes located at 1180 Duck Road. It will have a total length of 240' and will extend in a westerly direction perpendicular to the boardwalk. The main pier portion of the facility will be 234'x 6' and will have a 56'x 6' platform in a "T" head configuration at the end. A 25'x 4' finger pier will be constructed on each side of the pier and 4 tie -piles will be placed to create six 25'x 12' slips. Water depths within the slip areas range from 2.5' to 3' below NWL. The height of the proposed docking facility will range from +6' at the boardwalk to approximately +3' at the proposed slips. Adjacent piers include one that is located ±270' to the north that is ±200' in length and one that is located ±95' to the south that is ±195' in length. The alignment of the docking facility will result in the shading of ±1,940 sf of SAV's; however, this is the only area the Town was able to secure an easement for and where the shortest distance required to reach appropriate water depths for dockage is located. The docking facility will be for daytime use only and will have no amenities such as wastewater disposal or fueling. To prevent more than six boats docking at one time, the Town of Duck is proposing to construct a guard rail on the outside portion of the platform. The Town has obtained easements for the construction and maintenance of the boardwalk and docking facility from all property owners. No new impervious structures are proposed within 75' of NWL and staging areas will be located within existing impervious parking areas. All components of the project will be compliant with the Americans with Disabilities Act. Anticipated Impacts • The proposed boardwalk will result in the disturbance and shading of ±2,830 sf of ES AEC. • The proposed boardwalk will result in the shading of ±4,820 sf of PTA and EW AECs including ±1,417 sf of SAV. • The proposed boardwalk will result in the shading of ±50 sf of Coastal Wetlands. • The proposed docking facility will result in the shading of ±1,940 sf of SAV as well as the PTA and EW AECs. • The proposed docking facility will result in 6 additional slips for a project total of 10 slips. Submitted by: Ron Renaldi Date: October 24, 2013 0 Town of Duck Soundside Boardwalk — Southern Extension & Pier Addition Town of Duck, North Carolina �N '` 0 ~0 OCT 11 2013 Project Narrative 'OAST,'' The Town of Duck is the northernmost community located in Dare County on the Outer Banks of North Carolina. The Town is a resort destination that has an estimated population of 25,000 in the summer months in an area of 2.32 square miles. Since incorporation in 2002, The Town of Duck has acquired and is in the process of developing an 11 -acre park in the heart of Duck Village with a number of amenities that are attractive to residents and visitors. The Park has an amphitheater, walking trails, a gazebo stage with summer performances, a children's play area, and a soundside boardwalk and kayak launch. The Park is also the site of Duck's Town Hall. The Town is now proposing to extend its soundside boardwalk to the southern boundary of the Town's Village Commercial area. A 2/3 mile section of the boardwalk has already been completed which extends from 1186 Duck Road (Wings) to 1240 Duck Road (the Waterfront Shops). The goal of this phase of the project is to extend the boardwalk south from its current terminus at 1186 Duck Road to 1174 Duck Road. This would complete the Town of Duck boardwalk through the Duck Village Commercial area. The Town is also proposing an additional boat pier /kayak launch along this new section of boardwalk. The Boardwalk directly connects to the majority of soundside businesses throughout its length making it particularly convenient for pedestrians. In addition to a soundfront greenway, the Boardwalk includes several overlooks, designated areas to fish and crab, and a pier with boat slips to allow boaters to access the Village and tie -off. The Boardwalk parallels in close proximity to the Duck Trail with frequent access points at the Park and adjacent commercial properties. The Town has seen that a significant portion of the trips on Duck Trail are being diverted to the boardwalk and expects this trend to continue as the boardwalk expands. A recent count of pedestrians on the boardwalk for a one month period during the summer of 2013 revealed that 35,000+ pedestrians used the facility during that timeframe. The Boardwalk is an essential component of the Town's Vision for the Village as identified in the Town's Land Use Plan. The Boardwalk is a unique amenity that further establishes the Town of Duck and the Outer Banks as a travel destination. Previous permits received for this project include CAMA Major Permit #50 -07 as well as major modifications received in 2010 and 2011 for the northern boardwalk extension and boat pier. This application includes a Major Modification for a 770 linear foot extension of the boardwalk as well as a 240 foot boat pier with four finger piers. The pier would be designed for six boat slips which would be day use only and would not involve a launching facility. The boardwalk would traverse six private commercial properties along this section. The Town has obtained easements for the construction and maintenance of this facility from each of these property owners. These are included in this application package as proof of site control. The Town has also received an additional easement for a boat pier to be located at 1178 Duck Road. The boardwalk will generally traverse the shoreline of these properties. The project design has considered preservation of 1 Town of Duck Soundside Boardwalk — Southern Extension & Pier Addition Town of Duck, North Carolina riparian access and property owner requirements to maintain existing shoreline stabilization improvements. A survey of submerged aquatic vegetation, wetlands, and water depths was performed in the vicinity of the proposed boardwalk and pier. Water depths were surveyed in the area of the proposed finger piers under normal water conditions. Measurements indicated the range of water depths to be between 2.5 to 3 feet below the surface. The height of the boardwalk structure will vary from three and one -half to ten feet msl. The height of the boardwalk has been designed to match up with the elevation of existing bulkheads and piers and to minimize viewshed impacts to private properties. The pier will vary in height from three to six feet msl. Approximately 50 square feet of coastal wetlands (Black Needlerush) will be shaded by the boardwalk. Additionally, approximately 3,470 square feet of submerged aquatic vegetation will be shaded by the project. This is primarily in the area of the boat pier. Based on the survey performed, there were very few options to avoid SAV along this southern alignment and particularly in the area of the property where an easement was provided for this facility. The Town chose the location of the boat pier based on the shortest distance required to reach the appropriate water depth for a boating facility along this stretch of shoreline. This application also includes a 240 linear foot public pier with six boat slips to be located at 1178 Duck Road. As with previous phases of the project, the boardwalk will be a 10 -foot wide elevated piling supported structure. The public pier will be a six foot wide elevated piling supported structure. All components of the project will be compliant with the Americans with Disabilities Act. As required as part of this application submission, the Town has reviewed requirements for preparation of environmental documents in accordance with the North Carolina State Environmental Policy Act. Specifically, the Town has reviewed 15A NCAC 01 C .0408 and has concluded that the proposed project falls under both the general and specific minimum criteria established by this rule and would therefore be considered a Minor Construction Activity. Hence, preparation of a State Environmental Policy Act document would not be required in order to complete this project. With reference to general or specific criteria, the Town of Duck project: - Is not located near waters classified as either Outstanding Resource Waters or High Quality Waters by the State of North Carolina. - Does not involve the loss of more than one acres of class WL wetlands - Does not involve any proposed stream channel modifications or stream channel disturbance. - Will not involve the construction or expansion of a marina P.
