First, in reading through the mitigation plan submitted with the ePCN, I want to confirm it is the Final Mitigation Plan. The footers note it as "Draft Mitigation Plan" and the 401/404 Section 4.1 (page 11) was not updated to include stream impacts as it notes it would be. Also based on the Cross Creek Ranch design plans, it appears that the UT1 culvert replacement and the UT113 culvert installation are proposed at least partially within the existing stream channel (Sheets 1.3.8 & 1.4.2). However, the PCN Impact Map Figures do not call out any crossing impacts. In the Stream Impacts Table, were impacts associated with crossings lumped into the "relocation" impacts total? If so, can you please provide the culvert impact length for each proposed crossing. For the culvert replacement, the permanent impact would only be the difference in the structure footprints (plus any temporary construction impact). The mitigation plan states that UT1 crossing will be collocated within a utility easement and the landowner wants the UT113 usable for a public road in the future if the property is subdivided. If you believe either crossing qualifies as an ag crossing exemption, please provide a statement as why the crossing(s) are exempt. Moving forward please callout all crossing impacts separately on PCN impact figures and tables, and if applicable clearly state why crossing(s) qualify for Section 404 (f) exemption in the mitigation plan.
