1 Project Summary
1.1 Project Location and Description
The Scarborough Nutrient Offset and Buffer Mitigation Project ("Project") is operated under the terms
and conditions of the Scarborough Nutrient Offset and Buffer Mitigation Banking Instrument (MBI), made
and entered into by Water and Land Solutions, LLC (WLS), acting as Bank Sponsor ("Sponsor"), and the
North Carolina Department of Environmental Quality (NCDEQ), Division of Water Resources (DWR). The
Project was planned according to the MBI, Rule 15A NCAC 02B .0240, and the Consolidated Buffer
Mitigation Rule 15A NCAC 02B .0295, which became effective on November 1, 2015. The Project was
designed in concurrence with the WLS Neuse 02 Stream and Wetland Umbrella Mitigation Bank,
Scarborough Mitigation Site (SAW-2017-02527).
The Project (35.3211000,-77.98972222) is located in Wayne County, North Carolina, approximately four
miles south of the Town of Goldsboro (Figure 1). The site boundary is within the 8-digit Hydrologic Unit
Code (HUC) 03020202, in the NCDEQ sub -basin 03-04-05 (Warm Water Thermal Regime). This Project
provides riparian buffer and nutrient offset mitigation credits for unavoidable impacts due to
development in the Neuse River Basin, 8-digit HUC 03020202. Nutrient offset credits may be used for
stormwater requirements for new and existing development requiring nutrient offsets. The project
involved the restoration of riparian vegetation to reduce non -point source discharge of contaminants into
streams and agricultural ditch channels within the Neuse River basin.
The project area is comprised of two separate easement areas totaling 230.838 acres, which includes the
stream and wetland mitigation areas.
The as -built acres are as follows: 15.95 acres were restored for Neuse buffer credit and 15.57 acres were
restored for nutrient offset restoration credit. In general, Neuse buffer widths extend a minimum width
of 50 feet from tops of stream banks, while nutrient offset restoration area widths will extend out to a
maximum of 200 feet from the top of the channel bank. The buffer restoration credit adjacent to coastal
headwater stream mitigation is classified as alternative mitigation under Rule 15A NCAC 02B .0295 (o)(2).
1.2 Project Success Criteria
The success criteria for the Project will follow the approved performance standards and monitoring
protocols presented in the approved Buffer Mitigation & Nutrient Offset Plan (Plan), MBI, and were
developed in compliance with the DWR Rule 15A NCAC 02B 0295. Annual vegetation monitoring will occur
each year for a minimum of five years in the nutrient offset areas and for seven years in the coastal
headwater buffer restoration areas. Monitoring will be conducted during the fall season with the first year
occurring at least five months from initial planting. Permanent vegetation monitoring plots will be
installed and evaluated within the buffer restoration and nutrient offset areas to measure the survival of
the planted stems. Riparian buffer vegetation monitoring will be based on the Carolina Vegetation Survey -
Ecosystem Enhancement Program Protocol for Recording Vegetation: Level 1-2 Plot Sampling Only Version
4.2.
1.2.1 Vegetation
Twenty-eight 100 square -meter fixed vegetation monitoring plots were installed for DWR monitoring;
covering at least two percent of the 31.5 acres of riparian restoration area. The location of the plots is
shown on Figure 2. Photos will be taken from all photo points annually. All planted stems were marked
with flagging tape and a wood stake. Twenty-six of these plots are joint monitoring plots for 401/404. Two
additional plots, #37 and #38, were added at DWR's request post as -built and are only monitored for DWR.
Vegetation monitoring will occur in the fall each required monitoring year, prior to the leaf fall. Plots will
be monitored for a minimum of five years in nutrient offset areas and seven years in coastal headwater
buffer restoration areas. The following data are recorded for all planted trees in the plots: species,
common name, height, planting date, and grid location. The total number of volunteer woody stems will
also be documented and reported by species.
1.2.2 Performance Standards for Vegetation Adjacent to Single -Thread Streams
The measures of vegetative success for the Project will be the survival of at least four native hardwood
tree and/or shrub species (including bald cypress), where no one species is greater than 50 percent of the
established stems, established at a density of at least 260 planted stems per acre at the end of Year 5.
Appropriate native volunteer stems of tree/shrub species may be included to meet the performance
standards upon DWR approval.
1.2.3 Performance Standards for Vegetation Adjacent to Coastal Headwater Streams
The measures of vegetative success for the Project will be the survival of at least four native hardwood
tree and/or shrub species (including bald cypress), where no one species is greater than 50 percent of the
established stems, established at a density of at least 260 planted stems per acre at the end of Year 5 and
210 stems per acre at the end of Year 7 for riparian restoration areas adjacent to coastal headwater stream
restoration. The seven years of monitoring only applies to the areas receiving credit under Rule 15A NCAC
02B .0295 (o)(2) for buffer mitigation. Appropriate volunteer stems of native tree/shrub species may be
included to meet the performance standards upon DWR approval.
1.2.4 Performance Standard for Coastal Headwater Streams
The performance standards for the coastal headwater streams must be met each monitoring year for a
minimum of seven years to comply with 15A NCAC 02B .0295 (o)(2) for buffer mitigation (permanent
vegetation plots 1-12 and 15-18). Confirmation from the USACE that stream performance standards have
been met will need to be provided to DWR by the Bank Sponsor prior to issuance of credit releases for
riparian buffer credit along the coastal headwater streams. The success criteria for the coastal headwater
streams include channel formation within the valley or crenulation that must be documented through
identification of field indicators consistent with those listed in the mitigation plan, and continuous surface
water flow within the valley or crenulation must be documented to occur every year for at least 30
consecutive days during the prescribed monitoring period.
1.2.5 Visual Assessment
Visual assessments are performed within the site on a semi-annual basis during the seven-year monitoring
period. Problem areas will be noted (e.g. low stem density, vegetation mortality, invasive species or
encroachment). Areas of concern will be photographed, mapped, and accompanied by a written
description in the annual report. Problem areas will be re-evaluated during each subsequent visual
assessment. Should remedial actions be required, recommendations will be provided in the annual
monitoring report.
2 Project Mitigation Components
2.1 Project Components
The Scarborough Site includes a combination of stream restoration and enhancement activities on 11,306
linear feet of streams and 117.95 acres of wetland re-establishment, enhancement, and preservation. Out
of 230.838 acres that are protected with a permanent conservation easement, 15.95 acres (694,782 ft2)
are proposed to generate riparian buffer credits along coastal headwater restoration streams and 15.57
acres (35,390.92 lbs. Nitrogen) are proposed to generate nutrient offset credits. Per the MBI (Section IX,
E) and the Plan (Section 7.0), 10.19 acres of the 15.57 acres proposed for nutrient offset credits are
suitable for being converted into buffer mitigation credits (443,876.40 ft2) at a ratio of 1:1 and at 100%
full credit upon DWR approval. The Sponsor may use the 10.19 acres of riparian restoration mentioned
above for either nutrient offset credit or buffer mitigation credit, but not both.
The Sponsor will maintain two credit ledgers: one for coastal headwater buffer credits and one for
Nitrogen nutrient offset credits. The total potential nutrient offset mitigation credits and riparian buffer
that the Project generates are summarized in Table 1.

2.2 Design Approach
Riparian buffer mitigation and nutrient offset adjacent to streams was approved by DWR via letter on
March 291", 2019 and July 101", 2019. Scarborough is also a stream and wetland mitigation bank, and
restoration of riparian areas was accomplished through the goals and methods outlined by the WLS Neuse
02 Stream & Wetland Umbrella Mitigation Banking Instrument, Scarborough Mitigation Plan (SAW-2017-
02527) and the Scarborough Riparian Buffer and Nutrient Offset Mitigation Banking Instrument. All
riparian buffer mitigation and nutrient offset along channels begins from the top of bank and extends a
maximum of 200 feet perpendicular to the channel pursuant to 15A NCAC 02B .0295 and 15A NCAC 02B
.0240. Land use proposed for buffer restoration and nutrient offset was composed of row -crop
agricultural fields. Wetland mitigation areas are excluded from riparian buffer and nutrient offset credit
areas.
A riparian headwater valley restoration approach was constructed for UT1-RI, UT1B, UT2, and UT3.
Headwater stream restoration activities included excavating a broader floodplain at or slightly above the
existing bed elevation and will seek to restore groundwater hydrology and connection of surface flows.
Shallow flow paths were connected to allow initial flow of water toward reach UT1-R2, which gradually
transitions into a single thread channel that is more 'well defined' and the ditch that flows offsite was
plugged up to the property line. Figure 2 depicts the nutrient and buffer restoration plan based on actual
top of bank conditions. The riparian buffer credits located adjacent to coastal headwatervalley restoration
are based on the as -built survey centerline of the valley. The area of the buffer credits was measured
perpendicular to the length of the valley being restored.
The riparian revegetation plan included permanent seeding, bare root trees, live stakes, and controlling
invasive species growth. The riparian restoration efforts along the project streams are adjacent to
reconstructed stream banks and extend perpendicular from tops of banks 50 feet to 200 feet.
2.3 Construction and As -Built Conditions
The Project construction was completed in October 2020, planting in January 2021, the as -built survey in
February 2021, and the As -Built Baseline MYO Report was submitted in February 2021. Planting and
baseline monitoring activities occurred between October 2020 and January 2021. The conservation
easement is marked at least every 150 feet with Unique Places to Save signs attached to t-posts. The as -
built survey located the constructed stream channels, in -stream structures, tree -lines, a longitudinal
profile survey for each project reach, and cross-section survey for each reach. No significant deviations
were documented between final construction plans and as -built conditions. Additionally, no major issues
or mitigating factors were observed immediately after construction which required consideration or
remedial action.
3 Year 1 Monitoring Performance
3.1 Vegetation
Monitoring of the 28 permanent vegetation plots was completed during September 2021. Vegetation data
can be found in Appendix C with the associated photos located in Appendix B. The MY1 average planted
density is 542 stems per acre across all vegetation plots. All vegetation plots are meeting the average stem
density criteria. Table 2 details the average stem density per plot based on the number of years required
for monitoring and associated performance criteria.

Bald cypress (Taxodium distichum) was noted as a volunteer species during monitoring and more
volunteer species are expected to establish in future years. Visual assessment of vegetation throughout
the planted area indicates herbaceous vegetation is establishing throughout the project.
3.2 Visual Assessment
A significant population of kudzu was located along the western edge of the easement at the top of UT2
prior to construction. Construction activities and chemical control was implemented in September 2020
to control the kudzu, but this area will be closely monitored, and re -sprouts will be treated as needed to
prevent further establishment. This area is also not part of the creditable area for DWR nutrient and buffer
offsets.
Monitoring of reaches UT1-RI, UT1B, UT2, and UT3 was conducted by visual assessment to determine if
a preponderance of evidence indicated coastal headwater stream channel formation. Data collected is
included with the report submitted to USACE. All coastal headwater reaches are meeting the
requirements for coastal headwater channel formation and will continue to be evaluated during MY2.

Vegetation success is being monitored at a total of 28 permanent vegetation plots for DWR. Vegetation
plot monitoring follows the CVS-EEP Level 2 Protocol for Recording Vegetation, version 4.2 (Lee et al.
2008) and includes analysis of species composition and density of planted species. Data are processed
using the CVS data entry tool. In the field, the four comers of each plot were permanently marked with
PVC at the origin and rebar at the other corners. Photos of each plot are to be taken from the origin each
monitoring year. Tree species, height in feet, and vigor will be recorded for each planted stem.
